The new legislation does offer an exception for when a cookie is “strictly necessary” — for example, if a user is shopping online, a cookie can go from a product page to the checkout page without the need for consent.

I agree this is stupid beyond stupid...

But if shopping carts are allowed, then things like our Linking Codes that set cookies would be allowed. Affiliate program cookies don't track peoples web movements, they track information related to the sale.

I assume this is like Google Analytics and other real tracking tools. Which really, don't need to set cookies to do what they do.

Under the revised Guides, advertisements that feature a consumer and convey his or her experience with a product or service as typical when that is not the case will be required to clearly disclose the results that consumers can generally expect.

The revised Guides also add new examples to illustrate the long standing principle that “material connections” (sometimes payments or free products) between advertisers and endorsers – connections that consumers would not expect – must be disclosed.

The revised Guides specify that while decisions will be reached on a case-by-case basis, the post of a blogger who receives cash or in-kind payment to review a product is considered an endorsement.

The internet functions by a client (browser) REQUESTING a resource (web page/image etc) from a server (server).

If you type my website, you are opting to be served my website.
