Correction for the article, Stupak is a Democrat, not Republican. He is real conservative on social issues and a Christian fundamentalist.

Also, you've really sensationalized the story. The 10 year sentence is a maximum. You'll find in most states there are multiple year jail sentences on the books for serving or selling alcohol to minors. No one really gets that and it's the high end of the spectrum.

And stating that "making it available" is enough for the prison sentence is wrong. The bill clearly states you have to have intent to sell or provide access through a sale. That means you would have to be shown to actively be trying to sell to minors. Much different than just making it available to minors. It also includes firearms, tobacco, and alcohol. Rules are already very strict on this stuff offline so I'm not sure why you'd expect it to be different online.

It also seems that these are regulations on those actually selling it (which is why it's under the FTC). It's rather vague, but I wouldn't assume affiliates or exhibitionists would be included in the mix.

I'm not for the bill and don't know enough of the details involved in it, but you guys are really sensationalizing something by using some misleading statements to make it seem bigger than it is. I'd also be shocked if it passed considering similar bills have failed to go through under much more conservative Congresses.

We have this since years and I would really appreciate if that would be introduced also to the rest of the world.

Two reasons:

- my German clients would be able to compete again with all sites outside Germany who do not care about this for now and therefore have a massive advantage. more jobs for me ;)

- free porn will die. while people obviously do not care for copyright they DO care for going to jail because of committing a felony. there is not a single german operated tube site, tgp or whatever that shows free hardcore porn. because it is illegal.

and to say that it is technically not possible (like in the article) is a joke - cause it obviously is.

but it only will work if Visa and Mastercard push this - worldwide

They tried this in 1998. It was called COPA, it failed. This will fail too. If it passes it will be in the court system for a decade or more.

Could be a good thing as it would for all effective purposes kill free porn as the only Age Verification system is `a credit card. But if I recollect correctly because of the case law that was developed surrounding COPPA even if passed this law would have a difficult time surviving court challenge. Basically the court said there was a less intrusive way to keep minors from seeing porn namely filters. So it hard to see how they could successfully argue that basically making people pre-register to view porn is both less intrusive and more effective than filters.

well except 16 year old can have credit cards and of course teenagers have been known to "borrow" mom's or dad's credit card. So hardly an effective way of keeping minors from seeing porn.

The legislation, introduced earlier this month, already has been referred to the Committee on Financial Services and the Committee on Energy and Commerce for review

You do realize that 95% of bills die in committee. First it has to get reviewed then it has to be passed by the committee. That right there will take months at the minimum. Then it has to be introduced to the House, which could take many more months. Even if it passes a similar bill will have to pass the Senate. Which of course that bill will have to go through committee before being voted on in the Senate. Then both bills will have to be combined in a way that is acceptable to both Houses of Congress then it goes to the President for his signature. Then of course the inevitable lawsuit which of course will lead to an injunction until the case can be heard. Even if the lower courts approve it it will be continually appealed until it reaches the Supreme Court. Even if the Supreme Court agrees the law is Constitutional it could be the year 2020. Who knows that the internet will be like then.

i am talking about Germany - thats 80 million people and the second largest porn market worldwide.

and all i say is that you can come up with anything you want - like "there's no technical solution", "credit cards are not suffcient", "the internet has no borders" etc... but when politicians think they can put up something like an age verification they will. and they better look at what has been developed already somewhere else before they can come up with something really stupid they pull out their own asses.

Just to play devil's advocate...

A 12 year old can not walk into a 7-11 here in the US and purchase a Penthouse Magazine, but the same kid can see as much sick shit as he wants on the internet without any age verification whatsoever.

I remember a few years back it was still exciting to find a free image gallery of dirty pictures. Now you can hop onto any of a thousand tubes and watch as much insane sex as you want... but for some reason the excitement is gone.

Less free shit may in fact reignite sexual interest, desires, and maybe even sales!

I know it's a slippery slope, but porn was just much more fun and exciting when it was hard to find.

I see it two ways...
First off, you have to remember that we had a really good run in the 2000's. Yeah, the late 1990's were incredible as well. And a lot of the sales that happened from 2000 to 2007 came from 15 year old boys who were surfing our tgps a few years earlier. Then when they came of age and had credit cards they were ready to buy memberships. They had spent a few years wondering what was really inside those members areas.
I made millions of dollars selling memberships through my tgps and I can tell you 100% that those surfers started as teen boys and grew up with me online.
So on one hand, this would kill the affiliate model the rest of the way. Oh, it would still be on life support to some extent through non-nude blogging and galleries...but it would pretty much be dead as would all that traffic.

BUT...on the other hand...illegit tubes with full scenes and bit torrent sites with full members area rips have already killed it. Those 15 year olds that used to come to me now go to the tubes and torrents and no longer grow up waiting to get a credit card.

So, even though it would mean the end of my tgp business after all these years...I think it might be the only way to kill the tubes and torrents.

Of course with our luck, the govt. will give the tubes and torrents a free pass just like they did with 2257 laws and copyright laws because it's "user uploaded" and we will end up even MORE fucked than we already are.

Mine is a lot more accurate. When it comes to brick and mater, real people in the flesh "handing over" the porn, then it would be absolutely crazy not to have them "check id".

What we are dealing with here is what kids have access to from their own home where there is no way that a website nor a cable station knows who is watching. What happens in the home falls under "parenting" or lack of since the parents are the only ones who can block porn from their kids. They can put filters in place, not let the kid have a pc with internet access in their room, or god forbid supervise thier internet usage. If parents cant control what their kids do in their own homes, then the issue isn't with porn sites, they have much greater problems on their hands.

My point is too much free hardcore porn is desensitizing a generation, while simultaneously killing off sales, since it is all out there for free now.

To compare HBO to current internet porn is like comparing a firecracker to an atomic bomb.
