Except the person hired to do the work is not an employee of the person hiring. If that's the logic he wants to use then did he pay FICA taxes to the government on behalf of his "hire" like other employers? Of course not. Ok then so he is in violation of tax code if he's an employee. It's pretty simple. A person is either your employee or they aren't. And if they arne't then you have no rights to anything they create unless stated otherwise in a contract.

And you would think the programmer would bring up these issues beforehand....if its not brought up and he is doing (a cheap job to reuse the idea later), well that is just outright dishonest and probably why they are scrambling for work.

Edit: Just to be clear here, the programmer can re use anything he creates....even if he works for microsoft in their office....UNLESS a contract says otherwise.

Its the way its done from too many smalltime programmers in this business relying on the fact that most webmasters are unaware of this fact!

Clearly you've never worked for a company at all.

Copyright and patent are two different things. An idea can be patented. It cannot be copyrighted. At least in the U.S.

I write the code, it is my code. Period, end of story.

When I do something for resale my price is much higher than when I just do a script for someone.

just my

You did need his permission whether you agree with it or not. It is as simple as that.

Earlier in the thread you said:

he added a disclaimer he snuck in there i didnt see it till after i paid
So, it appears you even agreed to his terms.

Intellectual rights are pretty cut and dry on this situation, whether you like it or not.

Unless otherwise specifically stated the creator (not the conceiver) owns the rights.
