In example...a farmer was irrigating his crop with aluminum sprinkler pipe. The water sprayed onto a highway...and caused a car to lose control on the wet highway and the couple in the car sustained life long injuries. The farmer was sued...the outlet that sold the pipe to the farmer was sued...the manufacturer of the pipe was sued...the manufacturer of the sprinklers was sued...the county was sued (it was a county highway)...etc. If I remember correctly only the farmer was found to be liable...and of course he had insurance which for the most part covered the award...but not all of it.
that's just crazy. There should be a law against that kind of practice. It just jams up courts with idiotic paper work.

Sounds like a good reason to stop going on about your fantastic new site and how rich it will make you?

Yeah, I can't imagine doing that here... the other day, the BF and I were sitting in the living room with our two huge dogs and some drunk guy STILL opened the door (we had forgotten to lock it after taking the dogs out)... he was so smashed he thought it was his house... shit like that happens even if you're home. If we hadn't been RIGHT THERE idk what he would've done... =P

Anyhow, hope things go better for you. I need to send you a lucky charm or something, maybe a gold lucky cat like the one sitting on my desk right now, haha. For some reason even though I've never spoken to you personally, I like you, so I will send ~good thoughts~ your way <3

WTF dude, lock your damn door.. Sorry to hear on the lawsuit, it sounds like a shitty thing to have to go through, but at least you were already doing a bankruptcy so they can't get anything as it is.

On the plus side, at least you have your health.. Your pic in your avatar looks much better than old pics I've seen posted in the past.

In the US.. get mugged in the walmart parking lot and sue them.. You get paid.

there is even a case that happened in Florida for a Grocery store called Publix.. Girl goes to the atm at 3 in the morning. Store is closed.. Someone supposedly follows her from there to her house about 1 mile away and mugs her in the parking lot of her apartment. She SUES PUBLIX! I think they ended up paying her like 250k.

How do they determine the length of time you will be in BK....Canada/USA? Is it set in years?

Not to rain on your day but is this civil trial? If so your bankruptcy wont affect that if they judge against you they will go against future earnings just like they did with OJ. Now for them to collect thats a different story LOL

I hate to tell you this, but you are probably going to get fucked over in this case. I just received this newsletter yesterday. Bad precedent for someone in your position.

www . torkinmanes . com/newsroom/default.asp?load=6

Jury awards dentist's family $3.1-million in bar death case

In November, Barbara MacFarlane obtained a Jury award in excess of $3 million for the widow and sons of a dentist who suffered fatal head injuries when a fight erupted outside a Bar. The case illustrates the responsibility the hospitality industry has in dealing with its customers. The jury apportioned liability 35% to the tavern, 35% to its operator, 15% to its bouncer, and 15% to the victim.

(this was in Ontario)

judges in canada give out fuck all in cases like this.... the USA if different - in canada you get lost work and a kick in the ass - your lawyer fees will be higher than your judgment and you can only recover lawyer fees based on a fee schedule from like 1973 or something...

plus i'm in bankruptcy so the BEST case scenario is to be included in the estate proceeds which there are a LOT of other people in with HUGE claims.

the net result after lawyer fees out of her pocket will be negative if she wins HANDS DOWN.

it's not worth it here, this is just paying for a lawyer's kids to goto college

I feel sorry for her, but it happened on the street too, not on my company's property.

they're claiming no security - they had like 8-10 guards on that night, i was there that night about an hour before it happened - they all had radios...in her own statement she was standing beside a security guard - one even got shot protecting a client...

nothing to the landlord though - just the tenant and the manager/operator

i inherited them as a tenant when i bought the bld

i was not involved in their operation at all

I don't know, reading this article it sounds like the owner of the actual building got sued too. Not sure how that will work out in your case with a landlord / tenant relationship.

www . miltoncanadianchampion . com/news/article/288852

The jury found the former owner of the tavern — a numbered company — and then-operator Lea Hellerman were each 35 per cent responsible for David’s death, the bar for not having adequate staff and not ensuring patrons’ safety, and Hellerman for not providing staff with training about safe alcohol service, said Sue’s lawyer, Barbara MacFarlane, of Torkin Manes LLP.

thx, hope it works out best for you. i was sued in a similar fashion. it was the first drowning in a united states waterpark, 1984ish. i was the head lifeguard of the area, not responsible for watching the area where the drowning took place but i was sued anyways. got drug through court and told i killed the woman, etc.

Is she suing the city too? You know...since it happened out in the street and all. She'd likely win a better judgement going that route, assuming she wins at all. Sounds like her reason for suing is based on negligence, which looks pretty flimsy to me anyway. Some idiot shot at people on the street out front of the bar and that makes the building's owner responsible in some way...how?

Your lawyer should be able to shred her case six ways to next tuesday, hopefully with costs.

If anything the woman should be suing the idiot who shot her.

Is she suing the owner of the building across the street from the bar as well? Makes about as much sense as her suing you.

As for the comments about Winnipeg being a shithole, there are stupid people in every city, people get shot in every city. Get over it.

And Scott you live in Gimli now right? Then yes I can see where you wouldn't feel the need to lock your door all the time. Here in the city I keep mine locked out of habit. Residential breakins are the one thing that is consistently up every month right now as compared to previous years. It's the crime de jour right now.

spoke to the lawyer..

told him if they drop the suit against me I'd be co operative for them

he gets all lawerish and says I have to answer everything he asks...

I say - yes but do you know the RIGHT questions to ask......

anyway I told him i know a lot of info based on his breif that will really hurt him and a lot more that will help him so choose if he wants me on his side or not...

he has take to his client but looks like they want me in their side

i evicted the tenant for not paying a month after that happened.
