Notice of Termination from the Various Inc. Affiliate Program. Effective Date of Term

Anyone received these emails?


Dear * (gpid= *)

Our records indicate that you have never agreed to the terms and conditions
of any version of the Various' Affiliate Network Agreement that contains
language pertaining to the Stipulated Final Order for Permanent Injunction
as to Defendant Various, Inc. (the "FTC Order") filed on December 12, 2007.
(For purposes of this notice, Various includes any of its subsidiaries and
affiliated entities.) A copy of the FTC Order is available at
http://graphics.pop6.com/images/ftc_...gned_Order.pdf
or by contacting Various [email protected]. As a consequence
of your failure to agree to any version of the Affiliate Network Agreement
that contains language pertaining to the FTC Order, you have been terminated
from the Various affiliate program retroactive to December 12, 2007; you have
also forfeited any funds that we may be holding based upon your affiliate
account(s).

If you would like to reinstate your Various affiliate account, you must do so
by December 31, 2009 at 11:59 PST by logging into your affiliate account and
confirming: https://secure.adultfriendfinder.com...i?action=login
Beginning January 1, 2010, Various will not reinstate any affiliate account
and instead will require that you open a new affiliate account.

AFF posted into the other thread, it's for dormant accounts which have not yet agreed to the TOS.

Seems a bit strange to take 2 years to do this, and to use the suspend-then-reinstate model rather than just ask people to agree to the TOS by December 31.

What what else should they have done? Apparently, just asking affiliates to do it the first time didnt get the job done... so terminating the affiliate's account is a good way to get the affiliate's attention. Just agree to the TOS and there are no problems, whats the big deal?

I agree they eventually need to take more drastic action, but the question is did they really only ask once? Any ethical company that was planning to (even if forced by a court order) forfeit, ie NOT PAY, their affiliates would surely have given them several warnings before doing so.

Why did they forfeit the funds effectively immediately yet give affiliates 2 more weeks to agree to the TOS?...

It's not a great time to send out such emails over the christmas period when people are often distracted.
