But will they release all nonviolent weed offenders from jail and forgive fines? I hope so.

Same here. No reason they shouldn't do that also.

The scary thing about this is that no matter how much people bitch about the economy, I guarantee that this will be a close vote!

Agreed... I believe it has much to do with the amount of anti marijuana propaganda fed to all the baby boomers for years...

As stated in another thread, legalizing it in CA does not eliminate the Federal laws, which trump state laws.

Beware of the details of this new state law....

I am interested to read the fine print. I was solicited to sign the petition to get this law on the ballot but I didnt sign it.

For those of you who know me I am super 420 friendly

I didnt sign it because one of the general points on the petition I saw was that it would make it illegal in public.

The currently CA state law doesnt detail that, I can smoke anywhere that allows cigarette smoking as long as its 100 yards away from a school, church, childrens day care etc..

I enjoy 420 while going on hikes, the beach, a walk in the park etc.. or walking the street for that matter. Last thing I want is to be limited to only smoking indoors.

just my

Let's take a look at the most outspoken anti marijuana activist arguably the most responsible for making marijuana illegal. Let's check out the sound evidence he used and the quotes fed to the general public:

There are 100,000 total marijuana smokers in the US, and most are Negroes, Hispanics, Filipinos and entertainers. Their Satanic music, jazz and swing, result from

Marihuana leads to pacifism and communist brainwashing.

Reefer makes darkies think they're as good as white men.

Marijuana is an addictive drug which produces in its users insanity, criminality, and death.

You smoke a joint and you're likely to kill your brother.

Marijuana is the most violence-causing drug in the history of mankind.

Harry J Anslinger, you were an ass...

Actually, state laws trump federal laws unless certain circumstances are met...

They get around this by saying "the fertilizer used to grow this marijuana came from across state lines so it's Fed business"...

However, full state support and legislation would be very, very difficult for the federal government to trample on without massive recourse.

In a way, I think that things are fine as they are. Everybody who wants to smoke weed already does and nobody doesn't smoke weed because it's illegal. For those who want to avoid any potential prosecution, just go to a pot doc, say you have headaches or can't sleep and voila, pot's legal! $50 tax per oz? No thanks on that one. On the other hand, would be great to see the black market and all that goes along with it, reduced or eliminated.

easy to get a script already, this isn't about getting weed, it's about the state taxing and controling it. Wonder how they will control the people that grow it already?

goddam you're greedy...

i would be happy if you could just smoke in your own house and grow it in your own house without worry...

and trust me, first step is making it legal.. then comes allowing consumption in public..

1 step at a time...

also, you do realize that if this passes, it will open up legalazation in other states which is great..

take one for the team and quit bickering about the details...

you make that sound like a bad thing. you do know government is not inherently evil right?

i mean sure, things are fucked up, but that has nothing to do with legalizing marijuana and taxing it.

Wrong, I suggest you look up and read the Supremacy Clause (Article VI, section 2) of the United States Constitution or SCOTUS Altria Group v. Good, 555 U.S. (2008) which states

a federal law that conflicts with a state law will trump, or "preempt", that state law

So you mean you wouldn't vote for this just because you can only use it in the same way you drink a beer today. Doesn't exactly sound like good logic to me. But you are a stoner!

Good point, I thought about that. Im not sure yet if I will vote for it or not. Im just saying im a little cautious so I will read and do a lot of research before I do vote for or against it.

Just seems like there could be some details hidden in there that might hurt more then help.

The guys solicting for signatures kinda reminded me of those "Jesus loves porn" people from the AVN shows. Yeah they were dressed like stoners but the clothes looked a little new and the stains and faded jeans didnt look natural if you know what I mean.

Like they were preteding to be cool stoner guys but they seemd like posers trying to lure people into their lies

You can put a beer in a bag and consume it in public. If you do this with a bong or blunt you are likely to catch the bag on fire.

if this bill passes, would you think it will increase stream of people moving to California and bumping real estate up or it won't affect real estate much?

In my eyes if they legalize it with the same rules and regs as they do alcohol I am good with that. I personally do not agree with the age limit on alcohol, but that doesn't mean that I am going to say that it should stay illegal.

Sure there will still be tons of people who circumvent the system and grow it at home and stuff like that. That is something I am willing to accept.

Isn't it already decriminalized in Mass (at least for medicinal) along with gay marriage being passed? I might be wrong, but those Puritan blue bloods are starting to make us Left Coasters look like Nazis

It's just thats the only reason it may get passed, not because of it's medical benifits, but because it can be taxed

Sadly, I suspect any voter-approved legalization will be much ado about nothing until/unless the U.S. Congress and/or Supreme Court changes positions on this subject. (SCOTUS could do it on their own; Congress would need the Prez's signature, too, naturally).

Don't ask me; ask Angel McClary Raich and Diane Monson -- two California residents and medical marijuana patients who sued in federal court in 2002 in an attempt to preclude the possibility of being prosecuted under the (federal) Controlled Substances Act for receiving marijuana in accordance with California's medical marijuana laws.

The 9th Circuit agreed with the plaintiffs..... but then SCOTUS reversed the 9th.

So far as I'm aware, that decision is still the operative precedent in this area, and it really makes no difference whether any State passes a law explicitly making marijuana use legal (meaning beyond the currently State-law-sanctioned medical use), since any such law would contradict the Controlled Substances Act, and the current SCOTUS roster is unlikely to change that court's position, regardless of how lower courts might rule.

So, bottom line: until/unless the Controlled Substances Act is repealed, or revised to omit marijuana from the list of substances it pertains too.... legal marijuana in the U.S. will likely remain a "pipe dream," so to speak.

Topic of weed. This is interesting. I went to high school and teachers gave us statistics such as "20% of high school student try weed." Some years ago, weed was decriminalized for a short time in Toronto, then it was criminalized again.

Does weed damage the brain and make people more stupid? Some people say yes, some say no. One thing is for certain, weed reduces short term memory and some people can't even remember what they did 5 minutes ago when they were high.

Weed smoking will for sure damage your short term memory during the time that you are high. I also heard stories about hard drugs that damage the short term memory so much, that the person can't remember what he did 5 seconds ago.

What makes weed any different from alcohol?

It is great that in California it is legal.. but in Arkansas you will go to PRISON for less than a damn oz - go to jail for a seed :-(

We should get those rights as well.

Total bullshit

I'm all for legalization... I think the benefits to the economy would be huge, not only from taxes but from saving money spent on the prosecuting and imprisonment of low level drug offenders.

I did however read an interesting article yesterday about growers in Humboldt being against legalization as they fear it killing their their profits... "they say, it will drive down the price of their crop and damage not just their livelihoods but the entire economy along the state's rugged northern coast."
