Officer White ends up shooting McCloskey. Attorneys for White say he believed McCloskey had a gun. However, McCloskey was unarmed and appears docile in the video.

The jury will have to determine if the shooting was justified. White is charged with felonious assault and faces up to 11 years in prison.

Aaron Snyder testified this morning. He was with McCloskey the night it all happened. Snyder admitted they were speeding, but weren't fleeing. He says he did not witness the shooting and told his version of what happened.

Officer James Sedler did not witness the shooting either. He was sent to the scene after the shooting. The officer says he found a knife on McCloskey. White's lawyer demonstrated where the officer found the weapon. Prosecuters argue the knife was not concealed.

Tuesday, the shooting victim, Michael McCloskey, took the stand. He says he didn't realize an officer was behind him right before he was shot. He says he heard someone yell out, but couldn't make out what was said. Then he heard the gunshot.

After being shot in the back, "I remember begging for help. I remember having my arms out, so he fired out another round. I remember explaining to him I didn't have a weapon and that he was in the wrong for shooting me."

McCloskey's best friend testified that, after he called 911, Officer White didn't help him pick the bike up off of the victim. "I was telling him to get the bike off me. I was worried it was going to ignite on fire. I could tell it was leaking gasoline. I knew I was paralyzed, and I knew, if the bike was going to light on fire, I was going to burn alive," remembered McCloskey.

Officer White never seemed to look at McCloskey as he testified. White's lawyer tried to pick holes in the victim's testimony, but McCloskey claimed he never took his hands from the handlebar and was simply putting the bike in neutral when he was shot. However, he admitted to smoking marijuana and drinking prior that night.

White faces up to 11 years in prison if found guilty.

I guess if you are pulled over in Ottawa the best thing to do is to put your hands up in air and immediately start screaming that you are unarmed, and please don't shoot!!

i agree. but, depending on the circumstances, when a cop pulls over guys like that, they are pretty skeered and on the defensive, at least in my experience and from the stories shared from riding buddies. also, there could be a serious problem in that area with mc clubs. not saying there is, i do not know, but if there is, that cop was peeing in his panties when he pulled those guys over, i figure that's how the 2nd cruiser was on the scene so fast, lights flashing.

not taking the cop's side, that was a serious fuck up, but riding like that at 3am is really asking for A LOT of trouble.

Remember in earlier posts about Arizona/Illegals I stated nobody has seen real profiling unless they are riding a motorcycle?

Earlier in the first video about a minute before the shooting the officer drove right past a vehicle stopped partially on the road to follow 2 bikers that hadn't done anything. Talk about profiling.

If you're so scared that you need to shoot people in the back before asking them to dismount or step out of the vehicle, then you are not competent to be a peace officer.

If you made a mistake and shot someone in the back, you are also incompetent to be an officer.

you guys so fast to throw a cop in jail for 11 years are just as bad as the cop.. he's obviously very fearful or incompetent.. you discipline him accordingly.. but not even 1 year behind bars..

ever been to jail? You know what its like to lose your life behind steel doors for even 24 hours? Its no fucking joke. Your freedom is ripped away. That cop needs to be sued and disciplined or fired.. but jail is another ballgame. Put the Dahmers and violent maniacs in jail.. obviously this guy fucked up.. wouldn't you want a second chance?

I don't know about you but all I saw on the video was a cop following 2 guys until they accelerated hard from a stop then shooting one of them in the back while he sat on his bike. If I did that I would get more than 11 years. How about you.

When you have the ability to kill or injure someone by your mistake, you know going in how imperative it is to never make that mistake. No idea what the sentancing guidelines are for that. I guess just as harsh or light as the people have decided.

I do not think he is claiming he accidentally pulled the trigger. He may not have meant to paralyze a man that was no threat to him, but pulling the trigger was intentional.

He shot an unarmed man in the back and left him crippled. I think that is pretty fucking violent. 1 year in jail? What would you get for shooting someone in the back and leaving them in a wheelchair?

I wonder if the cop was using a Glock. I personally don't like the "safety" system. He might have nervously shot him. Still his or his departments fault.

yeah I get it... but cops are hired to carry guns, civilians are not.. this cop thought the guy was reeling back with a gun, which is lame bcuz he never produced one.. the cop is a chicken shit and for making a mistake.. a big mistake, he deserves punishment of some sort.. but 11 years?

If the guy wasnt paralyzed things would be different... but since he was, it becomes necessary to put the cop behind bars for 11 years? I dont mean to stick up for the cop so much its just a matter of principal.. many cops abuse their authority everyday trust me I know..

I was a reserve deputy sheriff for a while, and I can tell you that the only safety system that counts is that you NEVER put your finger on the trigger until you have decided to fire. It ALWAYS should stay extended along the side of the weapon. If this guy fired by mistake than his training totally sucked.

does anyone know the cop personally? history of being a prick or doing something like this?
Is anyones character taken into account anymore?

Adam, You clearly want to defend the position of the cop. We get that. Most of us are either pro cops or anti cops and our judgement gets skewed as a result. I have a cousin who is a cop, and a good friend who is also a cop. We naturally sympathize as a result.

In this instance though I think it's clear that the guy made a horrible call. The result means the person he shot in the line of duty will never walk again. He is trained to make calls of this nature on a daily basis. Forget the details about who it was and what time of day it happened, as those things are really secondary to why he made the choice to shoot this guy. If they came into his decision making process then clearly he deserves what he's likely to get because you don't just shoot an innocent guy on a bike in the back.

How would you feel if this happened to be a security guard who shot a biker messing around in a parking lot of JC Pennys?

Or alternatively if this were a hispanic guy in Arizona shooting a white guy in the back?

Same crime different circumstances that's all.

Someone in your family is a cop right?

Let's say it wsn't a cop who shot the guy. Would you then feel the same way? Having a badge is not a get out of jail free card

true, you can play with alternate scenarios.. like in the movie Colors.. the black guy in bed bangin that chick.. cops bust in, they say thats not him thats not him, guy reaches for his pants, one cop starts firing..kills'em. That cop was repremanded (or did he lose his job? cant remember) but that was just a movie..

in this case, cop shot a guy without seeing a gun... did he do it maliciously or was it truly a fearful mistake? If its the former, send him to jail, if the latter, a judge should make the cop pay the guy money and do X amount of good things for that biker for the rest of his life.. lol yeah right.. What good is jail gonna do? make other cops think twice? what good does it do the biker? vindication gonna heal his paralysis?
