When does using someone's video or images become 'fair use', under the law?

I ask this only as a question... No personal attacks against me.

I won't even comment on your response since it will only lead to more annoying attacks on what I say.

I only asked a question because 'FAIR USE' has been used successfully and effectively in courts ... and I was wondering what others thought of those decisions.

According to setion 17, Section 107 of the US code fair use is allowed for Section criticism, comment, news reporting, teaching, scholarship, and research.

There is not a set standard for the amount of content that can be used onder the fair use guidelines.

Agreed... It is a very VAGUE definition at best. It is WHY it is argued as a defense in court many times SUCCESFULLY. If argued effectively in court, most judges agree with Fair Use.

What makes the difference is... Did the ORIGINAL site lose money from the usage... And in cases of Cam Chat sites, NO! In fact, those sites increase their profits with more promotion of hot girls on their site... This is why sites that offer affiliate programs USE images of girls in the banners, iFrames, etc.

I agree that the definition needs to be more clear though! But the deciding factor in court and with juries is 'Did the original owner lose money from it?'... Usually answer is no. It is why cases of Copyright Infringement never see court time unless it is in the thousands of dollars... Some petty guy with a home computer, usually just get threatened to remove the content via scare tactics and warning of lawsuit. They usually remove it in fear BEFORE any proceedings take place.

My site uses Fair Use and been successful twice!

I mean, I post useful and helpful information... and I see others post useful information as well... and it always seems the same people have nothing better to do but to make fun or "attack" the posts...

Try repsonding intelligently with comments that are productive, or arguments of a substance.

Laughing only shows three things in people... Nervousness, fear or stupidity (psychology standard accounts)

So... Are you nervous? Are you afraid of the post? Or are you stupid?
