If someone has sex against someone's will then I consider that rape.

If the one being "raped" is too out of it to say no, then yes, it is rape.

Definitely a gray area, but if you think that person may be too drunk then leave them alone!

i think one should take into account the physical difference in the genders, which to me complicates the idea of personal responsibility because, in most cases, a woman cannot stop a man from taking her. there is no female-to-male type of equivalent crime. I generally agree that a woman should have the right to get black-out drunk without getting converted to unconscious sex toy. Men should be raised to be respectful to passed out ladies.

however the whole issue of personal responsibility is complicated by being black-out drunk: if the woman is not responsible for being unable to decline sex, how can a guy be responsible for black-out behavior if he cannot control himself as well? the Man picks who the perps/victims are based on who got hurt.

Not sure what the laws are if the person is drunk. I find the behavior a bit predatory, but I don't know if I would go as far as calling it rape. As long as they are not directly involved with their intoxication, e.g. dropped pill into drink, then I can't see how they can be arrested for rape. It's morally wrong, but as long as the girl can walk or talk, there's implied consent. If she's passed out...yeah, that's not only illegal, it's pretty fucking creepy.

Early in my career, in the JAG Corps in Germany, I defended a soldier who simply started by making out with a female soldier sleeping on a sofa in the day room of their company, fully clothed, during the daytime. That woke her up. It progressed to intercourse. The victim admitted in the Article 32 Hearing that she never resisted and never told my client to stop, though she did not want to do this. There was no weapon, and no threats or offers of violence were expressed. The charges were dismissed. Under the UCMJ at the time, the offense was required to be "against the will" of the victim and the investigating officer and the commander concluded that the case was too weak to have much of a chance of conviction at trial.
