Do you think that in the interest of national security, Homeland Security should have instant backdoor access to all Facebook data, including all private and password protected data?

curious what the opinions on this are and about digital information in general (cellular calls, texts, emails, etc.)

those are just amateur idiots, I really doubt any serious "homeland security" type criminals would hang out on there... but I guess who knows, I might be giving people too much credit, criminals might actually be THAT stupid....

If you are stupid enough to use your real identity and location on Facebook and further communicate any incriminating information on Facebook — you are guilty of being a total asswipe ... Any public posting is "plain sight" evidence — no warrant is needed for that.

However, without a warrant, none of the information obtained in a search of your Facebook account is admissible in any US Court. Maybe, there are ways to do so under the US PATRIOT Act.

Information gathered this way may not be used in a court proceeding but if not brought to light could be used "unlawfully" in any police or government investigation. This is done all the time if you are not aware of it ...

There should be no expectation of privacy online. It's considered a public space. Exactly like shouting from a box of soap in the town square legally. So I dont think it's going to matter in the end. We're being constantly monitored and thats it.

a counter point to that well thought out argument. People have been sued for making private information available on line. I am not sure (not sarcasm here) but that appears to contradict the lack of expectation or privacy online

Fights in courts are always part of the process, so thats always ok in my mind. But if a company is breached for example and their data is released, that seems a different situation. You might sue because you were assured a secure system safe from hacking with implied guarantee's or whatever.

the thing is in this digital age, our phones are connected, our contacts, our gps positions from our phones, etc, all linked together, and starting to be from an early age the information is compiled

This is UK, not sure if it's the same in the US, but if you consider that they can take your laptop off you at the airport for no reason and search the harddrive, and if you consider that they can search your house, it's not much different
