Anybody's heard anything on the 2257 case status?

My advice would be
Get your records in order, no matter what the news is!
Even if this bill gets defeated they will re present another modified version and another and another until one gets passed. |

"The Free Speech Coalition (FSC) and the Justice Department have agreed to extend of the original stipulation regarding a motion for a temporary restraining order against enforcement of amended 2257 record-keeping regulations. The original stipulation, scheduled to expire Sept. 1, 2005, will now be extended for an additional 30 days, until and including Oct. 1, or until the court rules on plaintiffs? motion for preliminary injunction as requested in Free Speech Coalition et al vs. Alberto Gonzales, whichever occurs first. The case is pending in U.S District Court in Colorado.FSC attorneys said they expect a decision by U.S District Court Judge Walker D. Miller on the Plaintiff?s motion for a preliminary injunction will be rendered well before the extended deadline." Well the new deadline is tomorrow and still nothing which leads me to believe that the FSC's posturing was a bit over the top. They gave the impression that it was pretty clear cut that the new regs would be enjoined rather quickly. The fact that they initially expected a ruling in August - and it is now a few hours away from October - makes me think that they may be in for an unpleasant surprise. I hope I'm wrong (I usually am). |

Ok, still no word? The agreement expires tomorrow (which is a Saturday), there has been no ruling, and we've heard NOTHING from the FSC?
The FSC made a big deal about the fact that they hired a communications director, who on earth is he communicating to? Certainly not his members...... |
Shhh no need to worry. It is only a coincidence that any rulings have been delayed while elsewhere in the country during this time the top cop has directed the aurthorties to center in on pornography cases that do not include CP.

ok. i can see the relvancy of 2257 issues with paysites, sponsor sites, content producers, etc.
what exactly does 2257 mean to the affiliates, the freesites, tgps, linklists, gallery makers, etc.. are we required to list on our site, for every sigle gallery linked or hosted, a page with 2257 info. that will be a huge project in itself. If a particular site has 1000 freehosted galleries, then the webmaster would have to research the 2257 info for each gallery & make a page listing the info. I do seriously believe that any webmaster promoting sponsor sites should verify & confirm that all fhg linked to from your sites have a 2257 compliance notice linked from the galleries, if not, remove them, or contact the sponsor to edit it in. all these issues regarding 2257 changes & the fbi antiporn war can all be very detrimental to any one of our businesses. we need to co-operate & do everything we can to protect ourselves & our businesses. I just contacted my attorney to find out what he knows about the 2257 changes, but unfortunately he is on a flight to holland, so could not research it for me, but i should know something by monday when i can chat with him. |

I will call the FSC office on Monday morning and post an update on GFY. I don't think there has been any decision by the Judge that I know of. We are all waiting.
I will send an email to Michelle and ask her or Tom to post any information to GFY as soon as it becomes available. If you have not received a membership confirmation, please email me and I'll look into it for you. I'd be glad to help. Again, we are all waiting, and waiting, and waiting....... |

2257 Stipulated Agreement Extended for One Month

A motion was filed in the U.S. District Court of Colorado late yesterday that extends for another month the original stipulated agreement between the parties for a temporary restraining order (TRO) in Free Speech Coalition et al v. Alberto Gonzales. The extension will terminate October 31, 2005, or until the Court rules on Plaintiffs? motion for preliminary injunction, whichever occurs first. During that time period, the Justice Department is restrained from inspecting or enforcing U.S.C. 18 § 2257 against plaintiffs in the case, which includes all members of the Free Speech Coalition. Terms of the original stipulation are once more maintained intact, and it is still the expectation of the attorneys for the Free Speech Coalition that a decision by U.S District Court Judge Walker D. Miller on the Plaintiff?s motion for a preliminary injunction will be rendered soon.
