I got an email yesterday from a client, saying the content he had bought from me and his design had been stolen and was being posted by another webmaster. I checked it and found it to be true.

Once I tried to trace the thief, I found his URL info false and his emails bounced. So informed APIC, the whole site and TGPs were down inside three hours.:) And if he tries to pop up again we will close him even faster.

I know a lot of you do not like or support APIC, but when you are fighting in the jungle, you need a warrior with attitude watching your back. Not someone trying to win a popularity competition.

well that was it...the email just read "sorry" nothing else...Suze Randals gave him rights to use one of her exclusive (in Suze Randals terms - in reality it was on every site on the net) sets for free...fuck it a $100 (maximum in her dreams) set when he was doing 50 plus sign up per day.....

I got a letter from them today. I was soooooo tempted to report that asshole to the florida bar for practicing law without a license.

He makes all these blanket claims and does not even include the info required under the law - and tries to use other laws that don't even apply. DMCA is for COPYRIGHT not TRADEMARKS.

If anyone takes ANYTHING of mine down, because of the "DMCA" request he made - I will sue him and Apic. He "signs" these things under penalty of perjury and doesn't mention what is copyrighted or who owns it.

He puts in bold print at the top:

APIC recently brought down two large sites harvesting pictures from Newsgroups. It took two weeks and a fight but they came down. Why eventually they found out APIC does not suck cock, it bites them off.

I called them with the "Are you for real?" speech, and after a yelling match, I explained that I was calling to get the issue resolved, and did not appreciate my hosting company being bullied.

Fairly shortly it was resolved that yes, my site was made in-house by my graphics designer, and even though one girl of ours was also used on 'schoolgirls.com', we certainly own the rights to the content.

IMO, APIC should concentrate more on TGP scum, or direct copies, and less on paysite owners who have 'similar' looking sites. Should they go after DMOZ because YAHOO! introduced the 'category search' idea?

Fuck just a boycott..lets get together and jointly sue them for sites which we have had shut down or fucked up because of them...I can get five people in who have total valid claims. If we could get about 20 plus law suits against them they would be shut down permanent style...They would not be able to handle that amount of legal bills.

Someone compile a list of content providers who do business with APIC so we can avoid buying anything from them.

I just bought it and will list:

1) Sponsors that refuse to do business with APIC - without a PROPER signed copy of a DMCA request.

2) Hosts that refuse to do business with APIC - without a PROPER signed DMCA request.

3) Content providers that do not use them

4) Anyone other business that will not honor anything other than PROPERLY FORMED DMCA requests.

In order to be on the list - you must also agree to accept counter DMCA requests from the viictimized webmaster. I mean alleged...

OK good call, then we get the domain (APICSUCKS.COM or whatever)and an initial site set up listing all APIC supporters, from content providers to sponsors (I know SIC Cash support them financially) and list them all on a site. Get as many "supporters" of our cause (The cause is for Steve Easton's arse to be fucked) and our supporters can then check to see if they are indirectly supporting APIC and avoid using those companies...This is a great idea.....

I know a few designers who hate APIC so they maybe perfect for this job...what elese do we need? We had some problems of copyright infringement with a gallery using Suze Randall's pics. It was a mistake since we're in Suze's program "Pics 4 Clicks", but due to that APIC Worlwide sent a request to our server administrator to get that gallery down. I contacted all the parts involved and I get 2 types of answers: Suze.net and California.net (where I have my co-located server) apologizing and APIC telling me that it was my fault, not theirs. Fuck APIC braindeads! Anyway, in a business where all values (and I'm not referring to stupid moralism, but truth and honesty) seems to be lost, sometimes happens something that feels like a breeze of fresh air, and that was what I felt when I get the reponse from Suze and her daughter Holly (read Holly's mail below)
