Hi guys
Paypal has just frozen my account and my funds claiming that I am in contravention of their user agreement, part of which is not to use paypal for sex-oriented material.
While my site does have nudity, it has NO sex, and I believe the term is "non-sexual nudity"...
anyway...
does anyone have any experience or advice on how to unfreeze one's account, or at least get one's money back

Did paypal freeze your funds because you've received money from adult businesses like affiliate programs or because you have a "donate" or "Buy Now" button or link directly on your site?

yeah...some people sent me money via paypal so that they could join my site...in other words they purchased memberships using paypal...
Also, I cannot contact paypal because now that my account is limited they are not allowed to answer questions on the phone.
So I sent them an email which they have not yet answered...
It seems like they have shut the doors and are making it difficult, if not impossible, to do anything about it
The problem I believe is that my site is "sex oriented" - there is NO sex, just nudity and only occasionaly some masturbation - but no penetration...
What I'm wondering...what is "sex-oriented" material? I mean a girl walking down mainstreet with a tight dress can be very sex orienting...many ads, while not showing any nudity, are VERY sex orienting...what the hell is "sex orienting"?
They don't make it clear...but they expect me to abide by rules that are not clear...
I mean, this is an adult industry forum...has anyone here had a "sex" issue with paypal?

Adult-oriented digital material is the issue. They have no issues for hard goods, dvds, toys, etc.

That sucks. Happened to me also. I ordered a fish pump from Ebay and had that paypal linked up.. I paid with a debit card but got refunded in paypal. Well, the process for me to get the money back is going to take 3 day's because he didn't have money on his paypal.. So it takes it from their bank account.. Well he doesn't have money there either so my money just goes to PayPal.. LOL. Only 6 dollars but still, that's a real scam lol

this is the craziest thing I've ever encountered...usually there is some consistency...but all I seem to find is a mish-mash of contradictory policies, etc...
For example, if I go onto ebay, which owns paypal, there is some (quite a lot) of hard-core material that is sold via paypal.
in other words, the owner of paypal uses paypal to traffic in hard core pornography...yet I'm penalised for a site in which there is no sex (that is, no penetration).
Some distinction has been made above for digital goods v. physical goods (DVDs etc), but paypal's acceptable use policy makes no such distinction and merely disallows sexual oriented material. It does not make exceptions for hard goods, or for US v. non-US goods.
What the hell is "sexually oriented" material. You and your kids can see some very sexually oriented material on TV, including, I believe, some frontal nudity.
Paypal promotes an image of good, clean, wholesome...but it has been suggested (not by me, but elsewhere) that Paypal may be the direct opposite of that good and clean, engaging perhaps in fraudalent activity by freezing countless accounts and holding the money for 180 days at their "sole discretion"...I am not at all sure that this premise of claiming "sole discretion" is legal...even paypal have to abide by the laws of the land...I think a good lawyer could show that their terms of acceptable use is a mockery.
But coming back to ebay...clearly paypal traffics in pornography...so where does that leave their high and mighty Acceptable Use Policy? And more to the point...how can I use this to get my money back???

well, I had people lining up waiting to join and CCBill does not accept VISA outside the US and Europe and so I thought I'd use Paypal...I guess I told myself that mine is not an adult site...I mean, there is no sex, just nudity...non-sexual nudity, I believe...so I thought it would be OK....
But I have since done a lot of reading and it appears paypal have a dark side...they are in the habit of freezing LOTS of accounts, and then pocketing the interest which I understand can be quite substantial...there have been lots of court actions against them and some class actions too.
My interest is to find a "cause of action" so I can take them to court. One possible area is that they act like a bank by holding money, but in actual fact they are just intermediaries who facilitate the transfer of money...So by holding money it is quite possible they are acting illegally...but I am not a solicitor, so this is a bit beyond me...I was hoping someone on this forum might have had some experience with this issue.

Paypal is a real stickler for things like this. Honestly I've found that once they freeze you and you've contacted them to try and get things right but they still don't go your way your pretty much out of luck. Paypal is awesome at times... but can be a pain in the behind at other times.

Paypal has been rejecting adult digital for years. There are options, Paxum as mentioned, zombaio is another. The ONLY gray area with Paypal applies to erotica ebooks, and to me it's not even worth bothering with - people will use your processor if your content is must-have to them. Build your fees into your pricing.
