technical explanation and some common sense:
tech- Jus Soli. "Right of the land." Anybody born in the U.S. is a natural born citizen, with a clear right to be president. Lex Soli. "Law of the land." People who acquire their citizenship through naturalization, such as Arnold Schwarzenegger. Experts agrees that these citizens are not "natural-born," and do not have the right to be president. Jus Sanguinis. "Right of blood." Anybody born outside the U.S. to U.S. citizens has right to U.S. citizenship. common sense- a child born to U.S. citizens on a U.S. military base while his father was on active military service is eligible for the presidency. |

Fun Fact :
Just questioning John McCains birthplace was enough to have Dynamo call people "fucking stupid" 7 times in this thread, call someone's life "fucking dreary", and tell someone else to go fuck themselves. Your Tea Party is showing, Dyna. http://amerikabulteni.com/wp-content...a-party-11.jpg |
John McCain’s father was an admiral in the U.S. Navy who was stationed in Panama in 1936, when McCain was born. This has led to speculation as to whether McCain is a U.S. citizen and whether he can be elected president, a question that was raised during McCain’s run for the Republican nomination in 2000 as well.
Section 1, Article II of the U.S. Constitution states: Article II: “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.” But McCain is a natural-born citizen, even though he was not born within this country’s borders, since his parents were citizens at the time of his birth. As a congressional act stated in 1790: Congress: “And the children of citizens of the United States, that may be born beyond sea, or out of the limits of the United States, shall be considered as natural born citizens.” |

Americans vote in Puerto Rico Federal voting rights in Puerto Rico but they are not full citizens -- only states can send delegates to the Electoral College and elect the President.
The McCain issue seems cut and dry, US servicemen that are citizens of states and registered voters can vote absentee as they are full citizens and their votes count. I think on "American soil" would only apply to people born here of immigrant parentage of one or both parents. That is Natural born -- on American soil and not naturalized citizens ... Section 8 of the US Constitution gives the Congress powers to enact laws of Naturalization of person to become a Naturalized US citizens Quote:
A child of two US citizens would meet the requirements to become President as to birth until SCOTUS says differently. When the parents of the child are both US citizens, American soil has no bearing. |

According to Natural born citizen | Wex Legal Dictionary / Encyclopedia | LII / Legal Information Institute
"Consensus exists that anyone born on U.S. soil is a "natural born Citizen." One may also be a "natural born Citizen" if, despite a birth on foreign soil, U.S. citizenship immediately passes from the person's parents." Section 5 of the 14th Amendment says: "The Congress shall have power to enforce, by appropriate legislation, the provisions of this article" Article 1, Section 8, Clause 4 of the US Constitution says that Congress has authority to create law regarding naturalization which includes citizenship. So who can be considered a natural born citizen is kind of vague, legally speaking. Congress says, under Title 8 of the US Code, Section 1401 defines natural born citizens as: "Anyone born inside the United States. The person must be “subject to the jurisdiction” of the United States. (This would exempt the child of a diplomat, for example, from this provision.) Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person’s status as a citizen of the tribe Any one born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S. Any one born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national Any one born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year Any one found in the U.S. under the age of five, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21 Any one born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time)" (source : Defining "Natural Born Citizen" | IVN.us) Chances are, McCain is easily eligible to be president. |

But thanks again for showing that you can't read good. Wannabe trolls get trolled. Like I do with you. |
I am of the opinion that if you have to be naturalized then you are not natural born.
a natural born citizen and not a naturalized citizen, would have been much clearer wording (contract law 101-- make sure it's always clear to the court) ... |

Now if he was not what he is they might have spent time looking into his place of birth. Let us not forget Mitt Romney's father was born in Mexico which kept him, George Romney, out of the white house. It was not on a military base either. Quote:

The legal requirements for qualification to run for President and Senator are very different. I suppose that's irrelevant to anyone who doesn't have a brain and is making tons of associations and wrong assumptions as the basis for an argument to begin with.
Having a President that may not be a natural born citizen and therefore lied, falsified documents, covered it up (allegedly) etc has nothing to do with a Senator born on a military base, out of the country, still fully 100% illegible to run for Senator. No wonder this industry is full of people whining that its over. Some of you tards are lucky to even happen to manage to feed yourself or tie your own shoes in the morning... much less run a simple business that requires little more than basic html and only a 1/2 assed attempt at actually working. "Article I, Section 3 of the Constitution sets three qualifications for senators: 1) they must be at least 30 years old, 2) they must have been citizens of the United States for at least the past 9 years, and 3) they must be inhabitants of the states they seek to represent at the time of their election."Idiots... |

the thing that flies right over **********'s head and the other completely stupid dimwits is that my being in a convo with them is what makes me appear smart. I've never claimed to be smart, yet, posting/debating with the dimwitted makes me appear smart to them.
IN fact, as they point out, my chatting about simple concepts and other topics where facts are not only self-evident, it's assumed the people with common sense are familiar with them, makes me appear like a know-it-all to the **********s of the dolt world. it's kind of embarrassing actually, I have to admit, I've only recently come to grips with how truly stupid ********** is. I had thought it was an act, like rochard. |
