One could argue that SI just serves ads. What happens to the surfer after the ads are served is not their responsibility. Hence they are not breaking the law.

Liken it to an affiliate sending traffic to a pay site that we know fucks the surfers with cross sells, has a shit members area, rips people off on the upsells from the members area etc.

Not saying its right. But is it illegal?

Its also important to note that spyware/scumware has affected this industry just as much as the saturation of free porn from TGPs.

I clean PCS on the side. Most of the machines I see can barely move after being booted because of all the shit out there now. Those people infected are NOT going to be able to sign up for a pay site.

When you go to the gym, does your trainer kick you in the balls so you have to limp around at a snails pace for the rest of the day?

I can't think of anything for the beer but I hope you get the point.. Spyware cripples peoples computers and costs less savoy computer users a shit load of money getting their computers fixed.

Like I said in the first post on this page. You serve the ads what happens after that you are not responsible for. You may not allow auto installs (or deceptive installs ie: terms are buried under a ton of text) but advertisers you link to may support them.

Its a grey line. People on both sides of the fence should be able to see that.

I'm not the internet police. If one of my advertisers is breaking the law, I turn over all their info to the FTC when asked. Just like yahoo does.

I loaded the javascript page again after the ringtone popup, then I get a software download page that has the terms listed here--

Sadly, you are correct. None of these people who spend 12+ hours a day on the internet have ever gotten any type of adware or spyware. They are all running Linux or Mac's and safe.

Notice I said "One Could Argue". As already mentioned. He knows he runs a grey line. The line is as grey as someone sending traffic to a program that has nasty cross sells, a shitty members area or hammers the user inside with dialers etc.

So the only REAL proof is done by courts, thus unless someone can point us to some legal papers , then its just "he said she said "

That being said theres obviously gaps in the law. Have you ever gotten a phone call from one of those automated telephone systems that gives you a pre-recorded message ? They piss me the fuck off , but technically they arent illegal.

That doesnt mean you cant give a beef about some company, but keep it to the facts.

In the worse case scenario i suggest if it means that much to a person he/she/they should collect as much info as they can and do whatever they can (i.e. legally on paper ), and a forum is a good way to start.

Lets take the recent case of the domain hijackers/hackers that recently stole thousands of very popular domains such as thehun and sleazy's sites f3.com etc etc

They offered the install files and the "hacker/spammer/hijacker" simply uses any exploit he chooses to install the spyware. The company just says they dont condone it they just offer a piece of software, and all they can do is shutdown users who promote their services in this manner..

So in the end they arent doing anything illegal all they are offering is the software and the affiliate chooses how to promote it..

This is what i call CLICK LAUNDERING. Does it mean they are doing something illegal ? no not yet. Does it mean they are shady as a bush at night ? probably. :)

Im also no fan of 12clicks, because of his posts (which as we all know doesnt mean shit) I think he speaks before he thinks. But that said. If hes doing something illegal then report him.
