Well we don't really advertise ACmoviepass much...people who now the secret promote us 8.2 month retention, no bullshit.

For what it's worth, I don't see any confusion between the two; different logos, acpartner is a webmaster program while acmoviepass is a surfer site, just the same first two letters. ACPartner's surfer sites don't begin with AC. ACPartner is using it to stand for "adult cash." There's also a different sponsor called adultcash, another one called adultcashier, there's adultmegacash, adultactioncash, adultpartnercash, and so on. ACPartner could use adultcashpartner, but then they'd be confused with adultpartnercash. Maybe I'm overlooking some other details, but I don't see the grounds for a trademark infringement claim. Or are you talking some other form of infringement, like they're using your content or something?

Yes you are overlooking that fact that "AC" is a registered trademark and its got products such as ACGOLD.COM, ACMOVIEPASS.COM, ACPAY.COM, ACPRIME.COM and ACSEXTOYS.COM ETC.

Ah, adultcheck I've heard of...wasn't familiar with acmoviepass.com. I still think it's a weak infringement claim. There are a couple dozen other companies with trademarks on AC as well. ACPartner is promoting to webmasters, not consumers, and I don't see any evidence of bad faith or attempts to confuse people with the similarity...it looks like a simple coincidence, with little chance of consumer confusion in the marketplace. They say "adultcashpartner.com" on their web site, so they're not trying to make people associate them with adultcheck. ACPartner's been operating for two years, and you haven't had any reports of confusion yet have you?

Send them a C&D, pay a lawyer $400/hr plus if you are so concerned. Don't come bitching on GFY.

Ye AC moviepass retains longer than the industry average when you are getting sales upgrading old AC Gold surfers if there are any left by now, but prepare for 1:9000 conversions on typical traffic that converts at 1:500 or better for any other decent video site from a REPUTABLE sponsor, and not one that screws over 10K+ webmasters.

The trademark office is weird, when you think they should get ya, they have no case, and when you think they have no case, they do, it all depends on the judge...

This reminds me of the Steven Cohen days when in 1997 Cohen served hundreds of folks who had the word, "sex" in their domain, may folks paid him off for a licensing which was cheaper than litigation. As it turned out it was not an infringement...

With this case precedence, I doubt AC has a case against this webmaster.

never dealt with Marty only ever dealt with Laith and his two faced, back stabbing side kick Tim. Adultcheck have been screwing webmasters over and keeping the money for years. They still owe me many many thousands of dollars. What goes round comes round eventually though ehh... It must be hell to be constantly worried that your past may come back to get ya at any time .....

No thanks necessary, I did not know who owned it, just saw the obvious legalities in trying to claim AC as anyone's.

Come to think of it wouldn't Thomas Edison have something to say about it since he got the patent on alternating current (AC).

I think that issue was more along the lines of Adult Check and Age Check both being AVS's, so it would be a little easier to confuse the two. :2 cents:
