Have to agree..for the sake of argument if it wasn't a fake...the guy was still moving somewhat and holding onto the gun...you're going down if you come into my place of business or home with the intention of harming me and I get the drop on you...I'm making sure you're dead before I call the cops.

I'm willing to risk it...and would push my lawyer to go for jury nullification...a lot of jurors wouldn't want to convict you for defending yourself...so chances are there'd be a hung jury and the state wouldn't want to spend the money to try and convict again.
Hell there's that man down in Louisiana that planned an attack on a boy scout troop leader who molested his son and was being brought back to the state.
It's old video from the 80's where he's sitting on this phone in the airport and they are walking the guy by and he turns and pops him like right in the head...jury found him not guilty.

the problem is people didnt actually watch the entire video or were distracted by something while watching. he CLEARLY raised the weapon and it then goes out of view in the direction of the clerk when he goes behind the clothes rack. clearly self defence. someone being down on the ground point a gun at you is the same as them holding it in your face.

Doesn't matter, if that is real he would be going to jail, all he had to do it walk away and call the cops after the first shot, he went over and shot him 2 more times while he was down, even if he still was holding the gun, they would say you were not in fear of your life anymore, shouldn't of walked over to him.

I am just speaking of the law, not of what most people would want to do, the cops would look at that video and arrest him for manslaughter, simplay as that.

but if it was real, you can't really see the guy after he was down and what he was doing with his hands/gun, so you can't really make a Homicide call on that

from that video, which is the only perspective i get to see, it appears the guy raises the gun and then turns over where the gun goes out of sight towards the clerk. unless theres other camera views we dont see, that's how it'll be argued. him dragging the guy away is something id question though.

Again the main problem is the cops would say you should not have walked over there, then you would not be in that situation. If you have a way out, you are not in fear of your life. A way out means - do not walk over to the person on th ground, run away and call the cops.

and if he bleeds to death and they can prove you could of done something you'd be fucked aswell. just calling 911 doesnt get you out of it.

I'm not going to argue with a statement as stupid as that. The guy went down but he still had a loaded weapon, period. I'd have shot the motherfucker until I was out of bullets. I'd rather take my chances in court than with an armed man who might still try and kill me.

if i was in that position id atleast make sure he was incopasitated before calling someone. that might of been what he was doing. id rather check and take the gun away then run and call the cops and get shot in the back when he gets up.

Anyway i am going by what i know, when i got my carring permit here in FL, we had a class taught by a cop who explains the laws about this, plus i have a lot of cops in my family, and unless you are backed into a corner and cannot get away from the person, you cannot go to the guy and shoot him again. Maybe laws are different where you live.

I am not agreeing with it, just saying this is what the cpos will say. once he is down you are concidered out of daner of death unless you are backed into a corner and cannot get away.

Everyone is missing the point, i agree with you, but you would be charged if they had that on film, simply as that, there was no need to go up to him after the first shot. that is what they would say, i do not agree with it.
