no it's not discrimination and if they're an at will employer it doesn't matter. it was most likely against their company policy and he refused to comply.

Discrimination does not have to be a component to have a valid wrongful
termination suit.

Buy a suit from Sears, then go sale suits at Macy's. If you get fired from Macy's

Unless this sales man had some sort of tenure agreement (highly unlikley) then he has no case against the car dealership. They can fire employees for any reason, as long as the reason is not an illegal reason. Illegal reasons would be firing based upon race, sex, religion etc. Firing based upon attire or being a fan of a certain team is not an illegal reason...though it might be dumb.

Furthermore, a Chicago car dealership has an argument that an employee wearing a Green Bay Packers neck tie can negatively affect sales since most potential buyers would probably be Chicago area residents...and thus they have a right to fire him for refusing to remove the tie.

Guy was pretty stupid for not removing the tie when asked. To me, it sort of suggests that he is a pain in the ass. What else is he refusing to do? Otherwise this would just be a one day "okay get out of here" kind of deal.

Also...

Employers should be able to let employees go for any reason they want, at any time. Just as an employee should be able to leave for any reason they want, at any time.

I was once fired from a developer position where I had no outside contact other than phone and email with clients for... having earrings... Sure I was pissed and was it justified? Absolutely not, especially considering I was putting in over 80 hours a week to get their only product on the market out the door (no exaggeration). While it sucked, I still support the right for business owners to make their own decisions.

He works at a job where he has to look respectful, a Packers tie isn't helping him close deals or cover his salary. When in sales you need to be neutral.
His boss was right to make an example out of him. It's not about the Packers its about looking the professional part and him saying no to his boss.

Depends on if it was a right to work state or not.

If it was a right to work state, then they can fire you for any reason they want except age, race, sex, and so on.
