Court rules against Arizona immigration law
Justice Department filed suit to block law it says violates U.S. Constitution

SAN FRANCISCO ? A federal appeals court is refusing to lift a stay blocking major parts of a tough Arizona law targeting illegal immigrants from taking effect.

The 9th U.S. Circuit Court of Appeals on Monday turned down an appeal filed by Gov. Jan Brewer. The governor asked them to lift an injunction imposed by a federal judge in Phoenix the day before the law was to take effect on July 29, 2010. The U.S Justice Department sued to block the law. It argued it violates the constitution because enforcing immigration law is a federal issue.

The case in the 9th Circuit is United States of America v. State of Arizona, 10-16645.

Why is this so difficult? Every time the police comes to my house they check my ID to confirm I am who I say I am. They do this any time I come into contact with them. If for any reason they believe a crime is being committed, they investigate further - Once they handcuffed my ass and searched my car with dogs looking for drugs, which was comical to me being as I'm so anti drug it's not funny.

They need to do this with everyone, period. Police should ID anyone they come into contact with. If they can't provide ID, there's a problem. Tourist? No problem - Let me see your passport and let me check it with customs to see when you entered the country.

Then again we need to have California stop handing out a driver's license to anyone with a pulse.

Carbon is not the problem, it makes up 0.041% of our atmosphere , 95% of that is from Volcanos and decomposing plants and stuff. So people in the US are responsible for 13% of the carbon in the atmosphere which 95% is not from Humans, like cars and trucks and stuff and they want to spend trillions to fix it while Solar Panel plants are powered by coal plants

There is generally no reason to produce ID for a cop, even if asked. If you are driving, you have to. If you are just at your house or walking down the street or a passenger in a car, you do not. Doing so opens you up to more trouble.

not sure about all states but this is pretty simple. In Florida if a cop asks for your ID and you refuse he will arrest you for " Failure to obey a Lawful command " Now your dumb ass goes to jail and they will make sure to fuck with you as much as they can.

Florida is the only place I've ever heard of such nonsense happening. Good thing I don't live in Florida. I would not be complying with such Gestapo bullshit like that.

Most likely its the same in most states. Cali usually has almost 100% the same laws as FL.

I see that law right up there with the " Knew or Should have known" law.

But at the same time I also understand why they are on the books.

Since I carry a gun, I am required by law to always have my conceal carry permit on me whenever I leave my house. When I drive my car I am required to have my license on me as well.

Truth be told 2 times in the past year I left my wallet at home when I drove away from my house. It happens.

If my friend came over to pick me up for a beer and a BBQ at his or her house, I may not have my license on me. Should I have to present ID willy nilly? NO WAY.

The catch 22 is do you think it's really fair that while on vacation you might get stopped dozens of times to show id while doing nothing wrong? At what point does it go from protecting the law to harassment? Same goes for a natural born citizen of Mexican decent. Is it really fair that in the course of 1 day you might get stopped 10 times just to constantly prove your legal? I'm sure at some point it would get very annoying.

I'm not saying I'm for or against this law. I'm just saying I can find issues on both sides.

National ID card tied into biometrics that can be scanned by any cop without you having to have a card woudl be awesome to eliminate identity theft, illegals, find fugitives etc.

Generally speaking yes. Usually they get called over here because someone set off the home alarm. Once they came blazing in - in force - because someone called in a domestic disturbance... I guess they thought I was smacking down my wife or something which was funny because we were dead asleep.

They aren't going to be pulling people over because they are Hispanic. In California and Arizona, and other states, that's a huge percentage of the population. They physically can't do that. It's like trying to pull over everyone for speeding.

But if your in an area where day laborers hang out looking for work, yeah, they should be able to roll up and ask for ID. It's no different than pulling over a car that's circled the block in an area well known for hookers.

When I was a kid I swore up and down that cops targeted "us kids" and pulled us over constantly. Now that I'm an adult I see why - They weren't pulling me over because I was a kid, they were pulling me over because I was driving like a fucking idiot and I just too stupid to see it. It's not much different with this law. They aren't going to be pulling people over because they are Hispanic, but instead because there are a number of things that look suspicious.

I guess I must not understand English as well as I had thought.
As I read the article the judge only denied the state's appeal to have the injunction against parts of the law lifted, not an actual ruling on the constitutionality of the law itself.
It still has to work it's way through the legal system and could still be upheld.

That headline is just a touch misleading

I guess Fox News isn't the only one to slant the stories

If they truly care about stopping the problem, they should setup a sting for the people doing the illegal hiring. Surely they can do that right now.. Are they? Or are they just more interested in blaming foreigners and getting more police rights.

How easy would it be to plant a latino police officer among the laborers and then arrest anyone who hires them?

Nothing is easy when it involves millions of people crossing over illegally every year.

Raids happen every so often but it requires an incredible amount of resources. This law is quite simple, and totally reasonable. Period.

Countless illegals are committing crimes in Arizona and apparently their constitutional rights are important to a bunch of dumbass liberals who don't even live there.

They do this already in Arizona. I remember right before I moved back to California they had a huge sting against a local company that did contracting for the Air Force base there or something and there was a huge stink about it.
