Freedom of speech? Judge sentences juror to "indefinite jury duty" based on racist questionnaire

http://www.nydailynews.com/ny_local/2011/04/06/2011-04-06_verdict_yer_a_joke_judge_forces_woman_to_eterna l_jury_duty_after_racist_remarks_.html

Quote:
An incensed federal judge sentenced a racist Brooklyn woman to indefinite jury duty on Tuesday after she trashed the NYPD and minorities.

"This is an outrage, and so are you!" Federal Judge Nicholas Garaufis told the woman, holding up her bile-filled juror questionnaire.
I dislike racist people as much as the next person, but wtf? This is unlike anything I've ever heard.

In federal court, they send you a long questionnaire by certified mail. Failure to fill out is a crime. I'm sure they get lots of "racist" answers, so hers must have been over the top. But she's in jury duty at whatever the feds pay these days. But no lawyer or Assistant US Attorney will seat her on a jury. So she'll be sitting there doing nothing day after to day, when they meet (fed juries meet irregularly). If she is a no show, she'll have US Marshalls looking for her. The Feds don't play around. As I said, she must have said some really crazy stuff.

They're gonna come for me one of these days because I've never answered a single jury summons, ever.

she wont be on any jury...the lawyers would eat the judge alive
he will keep her around to annoy her for a few days

or he could try to get her for some kind of contempt

Either she's self-employed and makes passive income or her job has agreed to pay her "indefinite" work pay for all the job time she will miss, because otherwise this could seriously fuck her life up. $5 a day to have to commit showing up at court in the morning and being there all day every day INDEFINITELY is fucking ridiculous. The fact that you can get out of jury duty if your work won't pay a certain amount of time that cases are expected to be (I think it was 2 weeks when I had gotten out of it) makes me wonder if this punishment should stand. Whatever the judge had up his ass that day, he's a bad judge if they let it get into the courtroom.

This wasn't city or county jury. This case is federal jury. I've served on both. Federal jury duty ain't what you see on Law & Order. Try suing the Feds, you'll get nowhere. County court was a fun picnic. Federal duty was fuckin' serious.

She might have to go through the process, but both sides will know who she is and she'll be lucky to leave the jury holding room. If she gets to the courtroom, minute she stands up to yell, US Marshalls will have her on the way to federal detention.

Dude, you are talking some massive shit here.

You wouldn't do anything except shut up.

"Keyboard Jury duty dodger".

Once you see that judge and those deputies in court reality will sink in; then
you will only ask the judge if you may have some ketchup to go with all the
crow you're eating.

If the judge thinks the juror made those remarks for the purpose of being
disqualified from jury duty then he can find her to be in contempt of court.

These judges hear bullshit every day and I think they know when the bullshit
is so over the top that it's simply contempt of court and nothing to do with "belief".

He could have sent her to jail.

WTS, I've been called up for jury duty on a State level a few times and honestly believe everyone should serve at least once because one day you might be judged by 8-12 who are too stupid to get off jury duty or might just want to be there.

6 years ago I was called up and it did not go well. The female judge gave her pitch about why you think you should not serve and to be honest. I raised my hand and spoke the truth. It went down like this- I told her my father was an LAPD detective for 20 years and heard stories/jokes often how they would "test a lie" in court because they felt the guy was guilty or a minority.

I then told the judge I truly feel all cops are liars and I will not believe anything they say unless they produce their job history with no internal investigations. The judge flipped out and turned judge judy on me and then ripped me a new asshole in front of everyone about being prejudice etc.

After she was done I smiled and said, your opinion of me concerns me about as much as other civil servants who pick up my trash or power-wash gum off sidewalks. There was a long awkward pause and then I was dismissed.

Not only is it a true story and a fact, but I've been in and out of courts easily a 100x.
I see your point. I've avoided duty as it would have been a financial disaster. But when I served, it was very educational and better than any great book I read.
Although my 1st trial was a lady suing her insurance company over storm damages.

After a coke charge & some time, I saw the good & bad of cops and criminals. Good criminals & really bad criminals.

I would today go into court and be the most fairest juror, as I know cops lie and not every accused is guilty. And some criminals are so guilty that the damn trial is a waste of time.

Years ago, a magazine proposed we hire professional jurors. Not people trying to get out of duty or people too stupid to get out of duty. Just fair jurors.

I worked at the Post office. Jury duty was a vacation compared to work. One fellow employee tried to volunteer. No damn luck.
I did my best to keep a jury one more day, anything but back to the PO. Knew the guys were guilty, but sitting in a chair beat bucking 70# mail sacks.

Not sure about EUSSR, but judges are not bureaucrats. Bureaucrats belong to the executive branch (or of the king), actually, judges protect people from the king (president), as in upholding the 5th amendment. Opposed to the police (bureaucrats) beating a confession out of a prisoner.
Judges have to have control of their courts, so rules are created. In federal court, they are very strict of these rules. More so now that criminals think killing a federal judge will get their case dismissed. Or a bad president will try and remove them.
Try going to civics class. King/President vs Parliament/Congress vs Judges/Courts. They all have rules to follow. This woman broke all the rules.

NO ONE should be sent to jail for having an opinion, no matter how messed up. If I were her I would hire myself a first amendment Lawyer and sue for unlawful detainment under the first amendment.

She would have a good chance of winning IMHO.

It turns out that this is the same judge that claimed the the FDNY (Fire Department) test was racist because not enough minorities passed...

He seems to do a lot of racial grandstanding...

http://www.wnyc.org/articles/wnyc-ne...roposals-fdny/

"New York City won't be hiring new firefighters anytime soon, even though city officials say they are needed to keep the city safe. On Friday, the city rejected all five of the hiring plan options laid out by a federal judge. Judge Nicholas Garaufis proposed the alternatives this week to allow the city to hire more than 300 firefighters who took an exam he had ruled was discriminatory.

But in a statement, Michael Cordoza, corporation counsel with the New York City Law Department, said all of the proposals are "bad public policy," and include "race-based quota" options. He said the city had no other choice but to reject them.

"The citizens of this city are entitled to firefighters who are hired based on their ability rather than on race or ethnicity," he said. "We are committed to ensuring that only the most qualified applicants become New York City firefighters while at the same time doing our very best to recruit the most diverse group of firefighters possible." Cardozo added that hires from the current applicant pool would have represented the city's most diverse yet, had the city been allowed to hire the test's top scorers without using any of the judge's proposals."

Is this the same FDNY that rejected a 911 memorial painting in their honor because
the artist included minorities in the art work?

Well, using "quite sure" and "may have" in the same reference is quite clearly a sign
that you don't know what you are talking about.

It was firefighters in Worcester that rejected the painting, not New York. Take the time to read what you link to.

The main point of contention by firefighters, including those in New York, is that the firefighter in the middle is African-American instead of white

Carbon is not the problem, it makes up 0.041% of our atmosphere , 95% of that is from Volcanos and decomposing plants and stuff. So people in the US are responsible for 13% of the carbon in the atmosphere which 95% is not from Humans, like cars and trucks and stuff and they want to spend trillions to fix it while Solar Panel plants are powered by coal plants
think about that
