Video Secrets Cookies = 0 days?

From a post on the pond, it was brought up that VS TOS shows a 0 day cookie. The affiliate then allegedly emailed VS and was told there is a 30 day cookie. However, when I just checked VS TOS, that section still appears:

6.5

(iii) A person shall not be deemed a "referral" entitling You to any commission or referral fee of any kind if that person leaves the Company site after having been directed there through the hyperlink banner ad or other promotional link (which has been supplied to You by Company) on Your website, without becoming an Company subscriber or purchaser of services of a type that entitles You to a commission or referral fee, even if at some later time that same person returns to the Company website(s), not through the banner ad or other promotional link (which has been supplied to You by Company) on Your website, and at that later time becomes a subscriber to the Company site or a purchaser of services from the Company.

If it was truly a 30 day cookie, why would the TOS not be changed in order to reflect that 30 day cookie?

Official reply, I asked about the cookie settings just last week and was told they are for 30 days.

Thanks for the reply, V. Still leaves the question of why it's not written this way in the TOS, however. It's like Dedi said, TOS = truth or they could claim otherwise at anytime.

It doesn't say one thing or another about it, but I will bring it up tomorrow.
Whats important has been answered

I looked on "the pond" and didn't see anything about this in recent time

It was an older thread, started February 6th 2011. Which is why I'm wondering why the TOS haven't been updated to reflect the response that affiliate apparently received via email. Search under "Tos" to receive the results.

It's important to me, as a VS affiliate, to have the TOS reflect that the cookie is either 30 days, or not. As it stands now, with the TOS section I posted, it's definitely not 30 days and the day of "take my word for it" agreements are long since gone.

Almost all TOS are "take my word for it" agreements since programs "reserve the right" to change TOS anyway and anytime.

Only way to avoid this is to either start your own program and fuck over your own affiliates or be an affiliate and keep getting fucked in the ass

In short, it says if a person clicks your banner and is taken to their site, and then leaves their site without making a purchase, even if that same user returns to the website later, it's not a referral and we get no commission.

So, a user has to make a purchase while they are on the site the very first time or we get dicked.

Wow, is this more "legal shaving" 'cause it's in the T.O.S.?????

do a test signup - you'll know soon enough whether it's a 30 day or a 0 day cookie.

I did around the time I created the thread. It just went through now. So, good news. I don't understand why you would want to leave your TOS like that though. It reads like there are absolutely no cookies, and if a user leaves the site, you're fucked. I hope they change it for their own sake.

Do you have to try to be such a huge douche or does it come naturally to you? I generally afford respect to people on the interwebs and especially old people. But you are one miserable SOB!

It is rather likely that this is legal protection. The TOS does not say there is a 0 day cookie, it says they do not have to pay you once the person leaves. If the person clears his cookies, or under many many other circumstances, this would keep them harmless.

I doubt there is more to it than that.

The TOS is going to be reviewed soon by legal

The cookie is for 30 days, end of story

This is not directed towards VS, but what will stop a sponsor from changing the TOS,Then in a month change it back and not email there affiliates. Then when you say it is in the TOS, they have already changed it.
