ICM countersuing Manwin and Digital Playground - this should be fun

http://www.thedomains.com/2012/10/01...r-120-million/

Quote:
Manwin has colluded with at least, Digital Playground, and their related companies, affiliates, brands and certain third party affiliates to prevent the emergence of other tube sites through improper means in order to protect its dominance in the relevant market or markets as alleged herein.

Manwin, Digital Playground, and their related companies, affiliates, brands, and certain third party affiliates have conspired to boycott the .XXX TLD and have coerced and/or encouraged the boycott of .XXX websites by third parties.

In order to maintain a monopoly over the relevant market or markets as alleged herein, Manwin, Digital Playground, and their related companies, affiliates, brands, and certain third party affiliates have intended to restrain trade in the product market mentioned above through inhibiting commercialization and utilization of the .XXX TLD.

Plaintiffs are informed and believe that Manwin and Digital Play- ground have combined and conspired to undertake at least the following anti- competitive practices intended to restrain trade in the relevant market or markets
(and so on)

Seems like kind of a "Fuck me? Fuck you!" countersuit but who knows. Entertaining nonetheless. So...will it get tossed or what?

ICM is starting to look desperate to me when they have to sue studios for not buying .XXX sTLDs.

I wonder if everyone else who didn't buy into their bullshit can expect to be sued as well?

I guess this is one way to motivate prospective clients.

I don't see how they can be forced to do business with organizations they do not want to do business with...

Seems to be a pretty weak argument on ICM's part. I'm not an attorney but encouraging people to boycott a product where the alleged "why" is the very thin argument that it was to maintain a monopoly on traffic/users etc, is not a very good argument that will hold up as it would then have to be proven that registering a .xxx domain at a retarded cost would somehow post some immediate benefits to the registrant at the direct cost of Manwin et al. Further, it seems pretty easy to prove they have little to zero industry support, were aware of it and couldn't have possibly have had any reasonable expectations of decent numbers of people registering .xxx domains. Given the basic tactics of ICM and their whole "blackmail-like" tactic of "you need to register it before someone fucks you", I would be wanting to stay out of court as that is the obvious counterargument - which when uncovered, detailed and examined is certain to lead to, or at least places them at great risk futher lawsuits.

Judge will be glad to see this case on his schedule, he can book an early tee time that day cuz that lawsuit is getting tossed out fast.

Anti-competition lawsuits are very very difficult to win even when the evidence is strong - this one has almost zero merit.

In the unlikely case that this won't get thrown out of court (imagine the evidence provided in the form of GFY threads ), Manwin will chew ICM up and spit them out. ICM doesn't have the required financial resources to take on Manwin.
