Have her contact the police immediately and tell them she suspects she is a victim of fraud. If it's a scam she might have a better chance of getting her money back if done quickly. If it's not a scam (and it probably is because who spends money that quickly) then getting the police involved will push normal people to pay her back ASAP or set things right. If in the states unless you make sure to push the fraud angle the police probably won't want to get involved and they will call it a civil matter. So it's important to state from the start that she suspects fraud and a scam.

whatever contract or lease that was signed to, will have to be broken in my opinion. i aint no lawyer. she needs to move in. not having a receipt for payment might be a problem. but dont let them get to the point where youd need to present that. thats why i say move in. or get fucked

If it were me I would do as others here have suggested. I would move in. When and if they try to kick you out call the police and show them the contract. Not much the landlords can do but deal with you and now you can come up with some kind of an agreement to get your money back.

I have been a landlord forever and people always pay in cash. Not unusual at all. Yes, they pay before they move in. Not sure if this person has zero belongings but moving if you are a normal person is a big deal. I would not move into a situation that might result in me having to move again in a few months. Now I am assuming she has somewhere to stay at the moment. The threat of police is great or court action but calling and working this out is the best method before any of that. And obviously you are not waiting two weeks ot get your money back. That is their way of getting you to wait and wait and ... wait so they can get away with it.

she probably does have the right to lease it. shes just saying her mother doesnt approve as an excuse to hold the girls money and lead her on indefinitely. and once you agree and accept not to move in, thats on you. no one has done anything illegal

She called and said "sorry, you can't move in" after finalizing a contract and being paid. She already admitted that she spent the money. She is not refunding the money. She says the tenant can't move in. It doesn't matter whether the tenant agrees or not to move in or with respect to the money that's now due/missing/stolen.

In a forum full of insanely dense people, you really are making the effort to stand out.

The point is not "what will they do" - the point is to pressure them to give the money back or honor their agreement. You keep turning up the pressure until they cave and you make sure things are documented and the law is on your side as you turn the heat up.

when people scam, they are using loopholes in the law. so theres no "just call the police". you do not create a common and successful scam when the simple answer is to call the police.

Actually, squealer was right, the person was obviously attempting to commit fraud and when their bluff was called they caved in. The fact that the unit is back up for lease right after the money was returned proves this is most likely a repeated fraudulent activity where the perpetrator is just hoping one person isn't aggressive at getting their money back.
