The parents of a 5-month-old were shocked when police showed up to take away their infant boy after they told a doctor they wanted a second opinion.

Caught on camera, the footage shows police entering the California home of Anna and Alex Nikolayev and asking Anna to hand over the baby.

?I?m going to grab your baby,? one of the several officers at the scene told Nikolayev, ?And don?t resist and don?t fight me.?

?He grabbed my arm,? the new mother told KXTV, ?so I couldn't take Sammy. And they took Sammy, and they just walked away."

The saga began about two weeks ago when Sammy, who suffers from a heart murmur, began showing flu-like symptoms.

The Nikolayevs took him to Sutter Memorial Hospital in Sacramento, California, the hospital where Sammy had been receiving regular treatment for his heart condition.

According to Anna, the couple became alarmed after a nurse came in to give the baby antibiotics.

?I asked her, ?For what is that?? And she's like, ?I don't know.?'

How, Anna wondered, was the woman working as a nurse but unaware of the purpose of a medication? Anna said a doctor would later tell her Sammy did not need antibiotics.

While still at Sutter, Sammy was admitted to the pediatric ICU for observation. Within a few days, doctors began discussing the possibility of heart surgery for the baby.

Motivated by fear, Anna took Sammy from the hospital without a proper discharge and admitted him to another hospital, Kaiser Permanente.

Taken: Though they got OK'd from a different hospital to take Sammy home, police let themselves in the next day and took Sammy into protective services

?I don't want to have my baby have surgery in the hospital where I don't feel safe,? Anna explained.

Police then showed up at the second hospital.

?They told us that Sutter was telling them so much bad stuff that they thought that this baby is dying on our arms,? Anna said.

At Kaiser Permanente, the doctor indicated on the infant's records that he was clinically safe to go home with the Nikolayevs and that there was no concern for the Sammy?s safety in their care. They went home.

On April 24, the police arrived at their house. Alex said he greeted them and was pushed to the ground when he asked if he was being arrested. They then took Sammy away.

According to Anna, a child protective services worker told her Sammy was taken away for ?severe neglect? but did not elaborate on the neglect.

KXTV reached out to Sutter Memorial and were told to contact child protective services. Reporters were told by CPS that they couldn't comment on individual cases.

CPS spokesperson Laura McCasland told the ABC affiliate, 'We conduct a risk assessment of the child's safety and rely heavily on the direction of health care providers.'

The Nikolayevs were allowed an hour of visitation with Sammy on Thursday.

An outraged Alex told KXTV. ?It seems like parents have no right whatsoever.?

?We did everything,? a tearful Anna agreed. ?We went from one hospital to another. We just wanted to be safe, that he is in good hands.?

A court date hearing was set for April 29.

It bothers me that this happened in Sacramento! They are always trouncing on
peoples rights. Several doors have been kicked in without warrant and Sac PD
does shady shit, like dropping people off in rival neighborhoods.

Sac is a bullshit city.

need more facts, all we have is the mother's side of the story - CPS doesn't like taking children away from their parents, there is probably more to the story. the mother sounds a bit nutty, an arrogant or whatever nurse unwilling or unable to explain to her what a medication was for isn't a good enough reason for removing a sick baby from a hospital. medical personnel have gotten worse and worse when it comes to interacting with patients and families.

tough calls have to be made when it comes to childrens' welfare. better to err on the side where the baby gets the medical attention it needs.

I saw this on the local news this morning.

If I understand correctly... They brought their child into Sutter Healthcare Hospital (big healthcare network here locally) with flu like symptoms, and the hospital detected medical issues they decided "required immediate care" and demanded the child stay in the hospital until further notice. Sutter said the conditon was "life threatening". Parents took their child out of the hospital without going through the proper procedures, and took the child to Kaiser Hospital. Kaiser told them them the "child was in no danger" and they saw "no reason for the child to be in the hospital".

Sutter hospital insists the child's health and welfare has been threatened and requires medical care, and when the parents took the child from the hospital without checking the kid out the hospital called police - which they are required to do by law.

This is bullshit. One hospital says there is a problem, another hospital says there isn't. In the mean time their child has been taken away from them. There is no reason for this; Kaiser Hospital says the child is fine.

I believe the child was born with some kind of minor birth defect which isn't life threatening.

Seems like a very complex situation. Hard to know whose side to come down on really.

I'm with the parents on this one, I had a similar situation with myself, but reversed.

Go to one hospital, told nothing is wrong, show the smirking shitty doctor something as clear as day on the X-ray. He yells at me, I yell back. Four guards escort me out.

I go to another hospital, they see it right away, immediate surgery. That was the single most beneficial surgery I've had related to my Crohn's.

So yeah, one place can completely fuck something up depending on who your care is entrusted with.

In this case it's just a matter of who is right...

I've never understood the complicated procedures to exit a hospital, it's like fucking prison if you say you want to leave they'll send in everyone and their mother to scare you into staying and then drag out paperwork until you give up. When it comes to an underage kid and being removed without doctor approval that I can understand having to report but having kid taken away seems a bit extreme

Parents have every right to question the treatment of doctors and to get a second opinion. You are also allowed to take your child out of the hospital against medical advice. Doctors are not jailers, and unless there is any evidence of abuse, they are NOT required to "notify CPS". My wife is a pediatric OT, and she was horrified the this story.

While I'm sure there is more to the story, I think I gotta side with the parents on this one. CPS seems to do everything ass backwards, taking kids who don't need to be and leaving other kids or not even investigating truly bad situations. As for Sutter, they shouldn't be providing any type of treatment without informing the patient (parents).

Stories like this are so tough to process aren't they? They make you want to pick up a tree branch and beat someone over the head with it, but who? On the one hand the CFS workers could be said to be overstepping. The Hospital admin might be a pack of assholes, and the cops, especially the one who allegedly pushed the father, might be deserving of suspension and jail time.

But then again on the other hand when you read up on some of their hundreds of other cases where there actually IS abuse and/or neglect going on, and see how difficult it is to instantly know one way or another if a child is in danger, you start to realize that it's quite probable that most of these so-called "assholes" are simply erring on the side of caution. They likely dealt with an insane amount of asshole parents who think they have the right to do what they want with *their* kid and the cops etc can go fuck themselves. See a few of these types first-hand and it's no wonder the cop pushed the dad out of the way.

Orwellian, possibly. Looked at from a certain point of view most definitely. But when viewed from all sides is it really so clear cut as an article like this would have you believe?

Hopefully the courtroom is unbiased and gets to the bottom of it, and issues a severe bitch-slapping to anyone found to have truly overstepped.

The way the story has been spun, primarily from the parent's perspective, it sounds like a cold heartless institution kidnapped a baby. However, from the hospital's perspective, the hospital staff apparently knew the child's medical history, and were concerned about the child's well-being, when the parents took the baby out of the hospital without authorization.

What would have happened to the hospital if the baby subsequently died? In this case, it appears that the hospital might have erred on the side of caution.

In any case, it appears that this situation has been resolved, although the baby Sammy must now undergo emergency heart surgery within the next 2 days:

The court also ruled Monday the parents must following all medical advice from now on, including not taking their child from Stanford without proper discharge.

It's not at ALL hard to know where to come down on this for me. On the parents side; on the childs side. The child was subsequently examined and said to be in no danger. The mother removed the child from the hospital whose nurse didn't know why she was about to inject antibiotics. This is not hard to figure out people. The mother was scared and took her baby out of that place that didn't know what was wrong and was about to inject him. What the fuck is with that shit? Where's the answer to that? Maybe she deserves a medal.

And what the fuck is with the police pushing the husband to the floor when he asked if he was being arrested?

No, this is not at all hard to know where to come down. Whose child is it? There's your answer.

And by the way, nothing in the original story precludes there being a condition that needs medical attention! The second hospital didn't say "there's nothing wrong with him now or forever" they only said he was OK to go home with the parents. VAST difference.

So the deal is really another typical "zero tolerance" policy brought to it's inevitable end. If you take a patient out without following proper procedure, the cops are coming to get you.

And by the way, nothing in the original story precludes there being a condition that needs medical attention! The second hospital didn't say "there's nothing wrong with him now or forever" they only said he was OK to go home with the parents. VAST difference.
it's thought the nurse took exception to the whole thing at the first hospital and blew her story out of proportion

i know when i've ripped out an iv and tried to walk out of an er, they did not like it at all.

If a Doctor is saying that its Life threatening, then in most states its a Felony to remove the child from care without going through the proper channels. They could have had the kid transferred.

Bring a new doctor into the hospital where the kid is for another opinion. Dont just grab the kid and run.

it has pictures in the articles.. it also explains that the doctors told the parents they could safely bring the child home

only thing that didn't happen was a discharge

apparently discharges are a big thing for the US.. i have never, ever, been discharged from a hospital

they tell me to leave
