Well Florida has changed the way it works. Dunn found guilty on 4 of 5 counts for killing a black kid by shooting into a car of blacks kids who were jamming to music way to loud for his taste.

If the jury acquits Dunn on the charge of first-degree murder, or they are hung, it would be a blow for the prosecution and the Davis family.

The guy was in the wrong for killing someone over playing music to loud. I am sure he could have went about that another way but to make it into a bigger story they twist that shit up.

He says he saw the end of a shotgun, but none was found. Had authorities located one in the car he may have been found not guilty, if charged at all.

The police fire at cars driving away all the time. They also shoot fleeing gunmen in the back. Theory being, the gunman has already made a threat to end a life and he must be taken out rather than allowed to get into position to kill. Now this concept is gaining momentum in cases not involving cops. But firing into a car where no gun was found is pretty tough to defend and all things considered (mentioned by the mainstream media anyway) it appears as though he was looking for trouble.

One of the guys in the car could hypothetically have disposed of a shotgun before authorities arrived. I'm not familiar enough with the case to say whether that is possible or not though.

You are using the definition of premeditation from fictional TV show scripts.

Premeditation only requires forethought; 2 seconds of thought is enough to premeditate.

They had a premeditation charge because of things he said/did before he ever got out of the car with the gun.

He had to think to get out of the car with the gun and shoot. That's forethought.

If a person is really scared then why not shoot from the car.
Why get out first?
Why expose yourself more to the weapon you fear by getting out of the car?

Answer : Because you ain't scared and you're going to kill somebody and you know it when you get out of the car.

But you are right about it being a mistake to try him on 1st degree murder.
Not based on law but based on the results of recent cases.
