News Restaurant Forces Black Diner to Prepay, Slapped With $100K

An African-American sheriff's deputy speaks out against the local franchise.

This case began nearly a year ago on December 14, 2014, but now the $100K lawsuit is official. Brian Eason, an African-American deputy with the Multnomah County Sheriff's Office, went into a Vancouver Elmer's Restaurant and was asked to prepay for his meal. Later, when he ordered a drink, he was asked to prepay again. According to the Oregonian, Eason then asked his waitress whether this was standard practice. The waitress explained that, due to recent parties walking out on their bills, her boss had asked her to request prepayment.

Also according to the O, Eason then left the restaurant and tried to forget about the whole incident but couldn't. He returned to the restaurant 30 minutes later and asked two white diners if they'd been asked to prepay. Eason said that these parties had responded in the negative. Now, Eason has filed a lawsuit in Multnomah County Circuit Court against the Elmer's franchise for $100,000.

Elmer's has not commented on the litigation, but director of restaurant support Jill Ramos has said, "We are disappointed to hear about the complaint which occurred at one of our franchise-operated restaurants." Since opening in 1970, Elmer's has grown to 25 diner-style locations.

The Elmer's in question is located at 7105 N.E. 40th St., Vancouver, WA.

if the service is not to your satisfaction why not just not go to that restaurant again? why look for some bullshit reason to sue? it's not like the guy was charged more, or ripped off, or harmed in any way, he is just using bullshit reason to score an easy payout...

Because we live in a hypersensitive society. It's all about perception, and with everyone being quick to charge people with racist actions, most anything can be interpreted as "racist". Here's a quick example of how this psychology works.

Two men walk into a restaurant at the exact same time, and there is only one open table. If the hostess escorts the black man to the table first, that's good customer service, everyone is happy. BUT - if the white man complains, he's labeled a racist. Now if the hostess acknowledges the white man first and seats him, then she's labeled a racist, and the restaurant is smeared for employing bigots. It's all over social media, the place is boycotted, yada, yada, yada.

You see how it's a catch 22 situation? At the end of the day, you are forced to cater to the black man, otherwise it will be considered racist. End of story.

But that is not what happened here. He was asked to prepay for his food and drinks and when he asked a white couple of they were asked to prepay he found out they weren't.

In the story he asked the waitress about having to prepay and the waitress told him that her boss was forcing her to do it and she thought it was discrimination.

If the boss makes the waitress force a black guy to prepay, but doesn't force her to have a white person prepay it is pretty obvious there are racial issues at work here.

I know I joke about dindus but in real life I am really cool with all races. I recently even started hanging out with a black female. I know some Indians and of course am down with the chosen people. You would not believe how fucking racist people are in Washington. Sure Seattle is very anti racist but once you get outside of it about 5 minutes you get some extremely racist people. And once you get outside of Seattle about 25 minutes you have KKK-type jim bob fucktards who would not even be allowed to survive in Germany in 1935 because they would lack the IQ to meet the minimums. I am not saying this event where this guy was made to pre pay is legit I am too fucking lazy to read the story. However I don't doubt it happened that way.

Did he ask any other black people if they were asked to prepay? Did he ask any other white people? Spanish? Asian? Arab, or Indian? Did the boss really force it or was that something she was saying just to add authority to her decision?

I worked as a server and bartender in college and I never in my life ever seen black people dine and dash. I'm not saying they don't, it just doesn't seem like something that fits a certain stereotype for them.

Sure, he didn't do full market research.

Here is the facts as he presents them. He was asked to pay in advance and was told by his server that it was the boss's decision to do so. He then found out a white couple was not asked to pay in advance. This means everyone is not being asked to pay in advance so why was he?

If this was just the waitress making this decision and lying about the boss forcing her to do it, we will find out about that in court. If the boss really did tell her to do this we will also likely find out how often this has happened in the past (at least as far as that waitress knows) and we might find out why this one guy was selected.

On the grand scale of things is this lawsuit going to end racism, change this guy's life or make the world a better place? No. But it might send a message of some sort that if you are a business open to the general public you have to treat everyone the same.

The Spokane area of Washington is known as being a hub for skinheads and neo-Nazi types. That area including Coure D'Lane, Idaho is a very racist part of the country.

Like Washington, the same can be said about Oregon. Portland is one of the most liberal cities in the nation. If you drive out of it though you don't have to go far before you are in redneck country. I grew up there and now there are plenty of people who are racist and some of them don't even realize it.

Not enough info in the article to make a reasonably informed judgment. It says he asked two white diners if they had been asked to prepay, but not if they were single like him or a couple. Maybe they'd had single patrons making like they were heading to the rest room and slip out the door. Something that a couple wouldn't be able to pull off. I'm sure it will all come out soon enough.
