La'Tiejira, who is 42, maintains she is not a transgender woman and she provided the federal court with documentation from a state court hearing in Indiana to prove she is and always has been biologically female.

La'Tiejira, who describes herself as an unemployed entrepreneur seeking modeling work, says Facebook left the hate-filled and defamatory posts up for six months, causing her emotional distress and suicidal thoughts.

The lawsuit claims the posts damaged her reputation and impeded her future livelihood. She endured harassment, hate mail and even death threats from the general public and former friends, as a result of Facebook's inaction, according to court documents.

Her attorney, Jimmie L. J. Brown Jr., said one key issue for the court is whether Facebook lives up to the promises it makes to take down hostile and defamatory comments.

Brown argues in court filings that Zuckerberg and his company should be held liable since their failure to remove the posts in a timely manner caused promoters, producers and filmmakers to cease making contact with La'Tiejira. Bullying comments violate the Communications Decency Act, he argued.

The former porn star is seeking $2 million in actual damages and $10 million in punitive damages.

La'Tiejira worked in porn films in Los Angeles in the mid-1990s under the name Lady Paree, according to court documents. On IMDB, a well-known Internet database of movies, she has 14 acting credits, including roles as a voodoo princess in a 1993 video entitled "Immortal Desire" and a film called "The Knocker Room," in which she played herself.

The heart of the matter is FB didn't remove it. It's like DCMA.
The arrogance of corporate America in relation to the customers boggles the mind.
If GFY didn't remove a libelous posting upon request, they'd also be liable for a libel suit.
If she gets the 12 million you can bet FB and the rest will hiring more Bangladeshi and Flips to work on serving customer requests.

Legally copyright infringement is not usually criminal theft. It is a civil matter and DMCA is not a civil libel tort.

You don't like Facebook -- I get it. Facebook doesn't like you much either LOL.

Most of you only defend the CDA when it protects you and oppose its provisions, or changes, when you don't like them. You can only have it one way or another so long as the CDA Act stands as written.

This really comes down to the case she won vs. Leisure Time Video for $2.5 million. They put her in a 1993 release that labeled her a post-op transgender performer. She filed suit in 1995 and in 2010 (15 yrs lol) she won a court verdict. Which later settled.

I cant be certain but Im going to bet that the judge had something in his verdict about references to her being a man be removed from all sites.

Im going to also bet that order was served on FB and they ignored it so now she filed suit against FB for violating the order.

I have had only one claim with Facebook's legal people -- over a username that was a trademark infringement -- the deleted that user in less than a day.

I am would think that if I was a lawyer with a court order they would say "yes sir" and that would be the end of it -- CYA seems their policy to me -- even when there is no court order and ''free speech'' is claimed.

There may be some anti-porn star sentiment here at play but I doubt Facebook would challenge a court order over something this trivial to them.

I am would think that if I was a lawyer with a court order they would say "yes sir" and that would be the end of it -- CYA seems their policy to me -- even when there is no court order and ''free speech'' is claimed.

There may be some anti-porn star sentiment here at play but I doubt Facebook would challenge a court order over something this trivial to them.

Could have fallen through the cracks. FB is too big to catch everything. And Im sure with a $2.5 million win under her belt, an "Im sorry we took it down now" from Facebook probably isnt good enough for this woman.

Usually the big corps get their way in federal court. Its usually stacked in their favor. I'd like to see the little guy, umm I mean woman, a get win here...
