"Effective April 18th 2020: At the time of enrollment, merchants must require the cardholder to expressly consent to entering an ongoing subscription service for recurring payments. This consent should be separate from the cardholder’s consent with any other general terms and conditions."

This is hard for sure

This is hard for sure
Just run a dark pattern, 5 pages where they have to click accept

page 1 tos
page 2 send page of tos
page 3 some benign bullshit
page 4 recurring payment
page 5 more benign bullshit.

Quote:
- Effective April 18th 2020: An electronic reminder notification and a link to online cancellation at least seven days before initiating a recurring transaction should be sent to the cardholder if:
a trial period, introductory offer or promotional period has expired;
or the nature of the recurring agreement has changed.

This communication should include:
an electronic copy of the terms and conditions of the subscription service; confirmation that the cardholder has agreed to a subscription, unless the cardholder cancels;
the start date of the subscription;
details of the goods or services;
ongoing transaction amount;
billing frequency or date;
link or other simple mechanism to enable the cardholder to easily cancel any subsequent transactions online.
Spam their email before and after make the cancellation reminder get lost in a sea of generic emails.

Hi Mitch,
Are you going to have to this ready as a gateway feature? Otherwise it’s impossible to implement efficiently and effectively.

Exactly. This should all happen at the gateway level, with the join forms they host, rather than expect webmasters to handle it. This includes CCBill, Epoch et al. If not we are looking at a major clusterfuck here.

CCBill already have the email thing in place as far as I am aware - I'm not sure if it's fully complaint - You use them don't you?..

You don't want to be using NB's default join form if you want to make sales. Unless they updated their design recently, the forms look older than CCBill's pre-flex forms. That's pretty much the only thing about NB I'm not a fan of. Otherwise, they're great.

Yes I use CCBill. Will have to check to see if they have implemented the new Visa regulations language on their forms and/or emails.

I do not use NB. I use CCBill and have my own custom responsive forms I designed which bring me a much higher join ratio than standard forms.

Hi Duke,

We do not host your tos or agreements. We supply a join form for those memrcjsnfs that still use our hosted forms. Of course, we are open to ideas that you may so feel free to email them to [email protected]. However, I know that 95% of our merchants all use our api and host their own forms.

Thanks, Mitch

Our general form is simple but typically converts very well and support s css as well. However, you are always welcome to use our API and host your own completely custom form, which is what the majority of our merchants utilize.

That’s just a new var sheet. I’m talking about the confirmed consent and the emails sent a week before rebill.

Ah, in that case like Mitch said, most merchants are hosting their own join forms and handling emails through their own member management...

It would be interesting to see what dates they implement various parts of the new polices and compare them to your stats to see how much of an effect it has...

Good idea! I keep records of weekly sales/rebills so it should be easy to do. But I would wait 3 months at least to see how this all shakes out. Of course, the stay at home measures due to Covid-19 is definitely skewing traffic and most likely rebills. So need to factor that in.

Actually shitty timing on Visa's part. Or good timing, depending on your perspective (consumer vs. webmaster).
