Fris....who are you again?? Weren't you the guy that was on some message board laughing because you scammed some small host on a $20/month account? How did you say it?? "It was fun while it lasted", I think is what you said, right? I assume you are just another GFY minion because you obviously think it is fun to come in here and just drop baseless allegations and run away while the real business people here are trying to get some real work done. Why don't you find someone your own age to play with while the adults work.

We have never had any big client down for 48 hours for any data center move. Hell, we have never had *any sized* client have an outage for 48 hours PERIOD and the people that matter know that. The only data center move that created any outages at all were from acquisitions and they were much less than that but the customers always had a choice of waking up one day and being down for good...I figure this was a better alternative for all involved.

THis is getting old...I am going to get some sleep...got a big day tomorrow touring the new 22,000 sqaure foot NatNet Corporate Office and Network Operations Center. Construction is almost done and we hope to be moving our entire staff in within 3 weeks

How stupid was that owner of nationalnet.com to sell it to anyone than Tony? T is the guy who would have paid the most for it. People like that slay me.

Sorry to hear that T. See you in the frozen North bro.

I would hope Webair purchased the domain as a funny joke, because with Cybersquatter laws these days, there's no way they'll be able to hold on to it. The domain was purchased by a competitor in bad faith, and a judge will be hard pressed to allow Webair to keep it should National Net file suit. Judging from the "TM" following their logo, National Net might want to file a federal trademark application for their name/logo. They have already established a common law trademark because of their Website, however, it would pretty much be an open/shut case if the name was officially registered. Common law trademarks as they pertain to the Web is a huge grey area.

It's obvious webair bought the name, they also bought iParking.com from Afternic recently using the same id (webair)... so yes it is definitely them.

WebAir made the biggest mistake they've could've made when it comes to domains... bad faith registration.... no doubt about it. National-Net will be able to pluck this from them easily, perhaps even for free, and webair will have an everlasting record of this mistake for all to see and for NatNet to reference in future clever marketing campaigns...

Because domains are such a large part of my business, I have lost all respect for webair because of this one stupid act. It was a crude, tactless, foolish move that will only ending up hurting their rep, not to mention losing the domain name and the $5K. Only way to remedy this is to transfer it to natnet before it goes to arbitration... unless webair wants this on their permanent record... It's one thing to compete on service, or pricing, but this was a stupid move and they win my "DOMAIN DUMBASS" award.

but let's give webair the benefit of the doubt... perhaps, webair bought it because they didn't want it to fall into the wrong hands and bought it right away and is planning on selling it to NatNet for the price they paid...

WTF were they thinking? No one would find out? LOL. You'd think a hosting company would know a little bit about how the domain game is played (UDRP/WIPO/ETC). I think it's sad if this is the only way they can compete with NatNet.

Webair just OWNED themselves.

Wow, I have Lee on ignore so I would have missed that. Thanks.

If true, that is pretty fucked up if Mike said that. I wonder if that is like an open invitation to anyone that is hosted by WebAir but thinks T is alright, and the purchase was idiocy.

That might be a lot of accounts.

Yep he did, in amongst all the abuse he threw at us too which we ignored (we figured he was high on coke or meths, or some similar substance).

We dont take threats as a company likely.

We're happy to be hosting all of our companies 200+ sites at Nat Net with the support we beleive we deserve as a company.

I highly recommend that anyone who is unhappy with their current host contacts Bill or Tony @ Nat Net and gets hooked up with them

Regards,

Lee

from where i'm sitting and no Trademark for NationalNet
there are a lot of things WebAir can do with the domain name and not have a UDRP dispute.
well pretty much everything under the sun except selling webhosting in adult industry.

that is what i thought for a second too when i searched uspto.gov nat-net and national net and the words are perhaps not descriptive enough. but it's not solely based on the tm right?

1 - national has been around a long time and is well known
2- national net even though they have no trademark, they could get on the supplemental registry and then move it over to the principal registry.
3- Unfair biz practices combined with a strong mark due to lots of advertising. how much has national net spent promoting their company between all the magazines etc.? Tons
4- 95% chance for national net to win here especially with webair's threats.
5- the only thing keeping this from 100% is that the page goes to seeq.com

btw, if slavik had bought the domain on afternic and then farmed the traffic out to non-hosting places i would not think there was much hope for a udrp. this situation is totally opposite and totally documented.

>> totally opposite
Thats my exact point, however i dont think anything is opposite here.
If the domain stays in its present form or if WebAir starts selling VOIP or computer parts or dial up service or gay midgets there are no Unfair biz practices here or any form of common law TM infringement. All these isssues will arise however once webair.com is linked from nationalnet.com

>> they could get on the supplemental registry and then move it over to the principal registry.
I dont think they would quality for a supplemental registry, they would go str8 to the principal registry.

2 Companies with an indentical name CAN conexist as long as they're both not selling the same product. Simple as that IMO

just my

Jesus I picked the wrong week to quit smoking. This thread is really pissing me off. If another company purchased NationalNet.com they did it to steal customers, make National Net look bad or extort money from Tony. Either way, it's fucked! Tony deserves better than that.

We've never even come close to a disaster like that and Tony can vouch that our system is complicated as hell. We are actually running CJ on Windows and ASP. Tell me that doesn't make the hosting company's job hard!

$20/month?

i use up to 40mbps a month. i have never had a virtual account ever. i have always had a dedicated server. with the amount of videos i host on my server.

"i assume"

thats right

you assume.

just like you assume i would buy a lame 20$ virtual account.

4- 95% chance for national net to win here especially with webair's threats.
5- the only thing keeping this from 100% is that the page goes to seeq.com
#5 - just an artifact left over from previous owner (buydomains)

but even if you ignore 1-5, webair made a dumb/shady/classless move and we are all now discussing it on GFY... and it's only a matter of time until this backfires on webair... and perhaps other current/potential customers will decide to steer clear of webair. I've lost all respect for them and would never take my business to them. I'm sure the loss of my business doesn't matter to them, but it all adds up... err... deducts from the bottom line.
