Because there wasn't an injunction, there was a deal reached between the two parties.

I'm guessing the DOJ went for the deal so they'd still have the right to prosecute other people who aren't members of the class action suit.

Now quit whining and go pay your $300 to join the FSC.

Plus the FSC website isn't all that clear on the type of memberships available

Lets say that "website/webmaster" designation

Lets say I have 10 websites
Thats 300x10 according to a line item on their join form.

What if one or two or three of those 10 is sorta the ones to be concerned about.

Now its gonna be 2x300?? 3x300?

But I really have 10, Do I now lie to them??


I'm thinking hardly anyone has just "one" website around here

What does 50.00 get you, just the right to say you contributed but no protection?


More clarity is needed there..
If they're swamped, that's a bad excuse too
I haven't had any emails with these questions answered either so far

If you go to the FSC's membership application page:

http://www.freespeechcoalition.com/application.php

and click on the "individual" catagory radio button;

you will see that an unincorporated webmaster's dues are $300 per year.

If you are incorporated and click on the "corporate" radio button, then the dues are $300/per site for the corporation.

Actually we called yesterday because we couldn't get the fax to work.

we were going to pay $300 to join as webmasters and the girl on the phone said wait....if your annual sales are below a certain threshhold you can join for less....as little as $50.

Our sales put us in the $300 category though so it came out the same. But they're definitely not trying to squeeze every dime out of you either.

The FSC is a trade organization, not a civil liberties union. Trade orgs look after the interests of their membership.

Let the DOJ go against one of the sites that is not a member of the FSC. See what happens to the FSC when that person wins a suit against them and the judge.

Why is this so hard to understand

1. The lawsuit was filed by a few individuals and the Free Speech Coalition for it's members. They are the people covered by the agreement.

2. The law is still the law and has been the law since the last century.

3. The new regulations still apply for EVERYONE, all that is delayed are inspections for the protected class.

4. If you a member of the protected class use the time to get your records in order because unless a permanent injunction is granted they can come and enforce the law in the future.

If you are not willing to participate in the law suit you can file your own or quit complaining about paying for less than one hour of an attorney's time.

DOJ can still prosecute others or at lest file against people... look like there fighting the big bad CP porn peddlers win public opinion then blame 'technicalities' on loosing the case when the FSC wins the case...

That is not the issue. When and if NON FSC members start getting prosecuted under this new legislation the FSCs case will become weaker and weaker.
