Can the police do this?

I have a friend who lives in a small town and has a pretty flashy fast car. He was at a restaurant near his house one night and when he left he drove by a cop on a dark road and the cop slowed down but didn't put his lights on. When he saw the cop hit his brakes he just floored it and took off. He pulled his car into the garage and about 10 mins later the cops were pounding on his door but he didn't answer.

3-4 days later he got a ticket in the mail for 100+ in a 30 mph zone, driving to endanger, and failure to stop for the police. Now, my question is can the police do that? I know they didn't see his plate, they never pulled behind him but they know he was at the restaurant because they went into the restaurant and got the receipt that had his name on it.

anyone have this happen to them and successfully defended it?

I think they can do it..we have something somewhat similar.called photo radar.you run a red or a speed trap and you get a ticket in the mail.They have cameras every where

Why wouldn't they? Your buddy sped off, I'll assume he was speeding. How do you know they didn't see his plate? Even if they didn't, they knew where he lived and the make of his car.

I dont see the failure to stop for police charge standing. The motorist has to know that he is being signaled to pull over, which hitting brakes does not accomplish. The speeding ticket will stand, prolly.

Thats happened to me two times on tickets. Just went and they cop didnt show up.

another ticket i got i was sitting at the railroad tracks and had turned my headlights off because i was having alternator problems. well low and behold I forgot to turn them back on. long story short, i went to the cop at the court and nicely reminded him what happened, (btw he treated me like a total punk kid when giving me the ticket), well he proceeds to say, "I dont remember what happened, so I guess there is no way I can testify against you." Judge threw it out. heh

Yeah, just a rumor. If it does exist anywhere, it would be a city ordinance, or possibly a state law/statute (very unlikely). I think its more like the rumor they had at my college where if the professor was gone more than 15 minutes you are automatically dismissed. Basically the kid in all of us wanting freedom. they have X amount of time after they see the infraction to issue a ticket for the incident.

i'm sure it's different for every state i believe it's 3 weeks here in new jersey

they can pull you over for an infraction let you go and if they want to be pricks issue a summons after the fact. it's happend to a few friends of mine with moving violations.

at this point we live in a police state they can do what they want whenever they want...

The Pigs can do anything they want pretty much until they get caught.

He has to prove you were doing 100+ No Radar No Ticket. Each time the radar is used it has a serial number for that use.

Was it Dark?

Why didnt he put the ticket on your windshield if it was you?

How do they know they have the right guy?

They have to prove beyond any doubt that it was you or your buddy.

Make sure you show up.... More than likely the officer will not appear there fore you win...

If you have a attorney. Send him into court for you and plead NOT GUILTY.

Have your attorney ask the citing officer to give him details of your description.

He can't.

Case won or thrown out.
