4 Teens killed when they hit train

The story is on the front of CNN right now. It is a truly tragic story, but it shows exactly what is wrong with the mentality of most Americans when it comes to liablity.

6 teens, ranging in age from 13 to 15, are off joyriding in a stolen SUV. Okay, so let's see. None of them are old enough to have a license. The vehicle is stolen. Got it?

Oh, did I mention it is something like 3 in the morning?

Apparently they are flying down a two lane road in the dark at high speed in a stolen vehicle without a license and they slam into the side of a stopped train (it was dark, they didn't see it, apparently) and 4 girls in the back seat are killed.

Wait for it: There is only 3 seatbelts in the back seat, it is a 5 passenger SUV (old cherokee).

Now, the father of one of the girls, who lives very close to the place where the accident occurs is up in the face of the railroad people for parking a train there (apparently happens fairly often). He says basically "If you didn't park the train there, my daughter wouldn't be dead, you fucker!" or something to that effect.

Holy shit. My mind reels dealing with this sort of fucked up logic.

Dude, I know you just lost your daughter and you are probably saying some stupid shit, but...

It's 3 fucking AM. Why is your 15 year old daughter out at that time without an adult?

What the fuck is she doing in a stolen car? Without a icensed driver? Speed in the dark.... likely without her seatbelt on because there wasn't enough to go around anyway?

There is any number of points along this story where the parent could have taken their personal responsbility and none of this would have happened. Blaming the railroad for parking the train there is so fucking far down the list...

Sadly, he will probably sue the railroad and win.

Yup, and it is the worst type of stupid legal result possible.

There was any number of steps that could have been taken to prevent this accident. The crossing, while in a dark place, does have non-lit crossing sites, and it isn't like someone snuck in late at night and suddenly plunked train tracks down. A train being on the train tracks... who would have thunk it?

The train company should sue the parents for damaging their train and loss of use of the tracks.

Forget who was driving the car or that it was stolen. Should trains be allowed to stop on unlighted crossings? Maybe there needs to be a law that at least puts light reflectors on all train cars.

theres alwasy 2 ways to look at it..

just because one party is grossly negligent doesn't mean the other party is also not grossly negligent. A court case is used to decide who is more negligent..

common sense i suppose might say both sides were equally negligent , but the train didnt lose a daughter.

If your drunk driving and hit a stolen car your still negligent for the damages you cause.

This sounds correct in concept. However, I'm sure there is more to the story. Sounds to me it was some dirt road not really meant to be a crossing.

I'm sorry; I feel for his loss of his 15 year old daughter. However, she was cruising around in a stolen SUV (breaking the law) and not wearing her seat belt (again breaking the law). Chances are there were dozens of other laws breaking (speeding, etc).

The person at fault here is the driver who was speeding down the road in a stolen SUV with passengers who didnt' have their seat belts on.

Man, if this happened to me I'd be pissed.

Seems to me this wasn't a dirt road, but a someone commonly used paved road - with no lights or anything. The SUV hit it's breaks thirty-five feet from the tracks.

They never had a chance.

Can someone explain to me why in the world a train would be sitting blocking a road with no lights? At 3am in the morning?

Can somone explain to me how they don't have lights at a rail road crossing?

Contributory negligence says that a plaintiff was also negligent in some way that helped contribute to the problem..

need more details - if a court decides that the train being left where it was with little illumination and that it was a potential hazard to drivers then they have a great case. if a judge determines even a cold sober driver might have made met the same fate then whether the kids were drunk or not shouldn't matter that much, when assessing damages/fault i'm sure the judge would take it into consideration.

i seriously doubt that somebody is leaving a train in the middle of an unlit road crossing - there'd be dead people every other week.

i agree, its horrible what happened, but its nobody's fault but the kids and the parents. i dont know about you, but if i'm driving down a road at night i use my headlights. i'm surely going to see a tran if its in the way of my driving path. theres reasons they dont let kids without drivers training on the road, and this is one of them.

One would think so. But how do we know they weren't coming around a curve and that's why they didnt' see the train?

You blame the parents? Those of you who blame the parents must not have kids, because - as scary as this sounds - you do not always know where your kids are at all times. The sleep over at a friends house..... sneak out....

When I was sixteen I lied about having to go to work - two nights in a row. The first night I had my driver's license confiscated by an off duty cop, and when I went out the next night to the police station to get it back I lost control of my car, and hit another car head on at 40mph. The car I hit had a 14 year old mentally retarded kid and his mother in the car. (Thankfully no one was serously hurt.)

I also remember when I was a kid one of my classmates snuck out, grabbed the family car, ended up drinking, and drove off a cliff.

We all did stupid shit when we were kids. Some of us lived to tell about it.

Yeah, that needs to be determined. Quite frankly the kids involved were irresponsible on many levels, but I can't say I'm keen on the idea of a train blocking a crossroad at night where there are no lights.

did you watch the video you posted earlier in the thread? the road looks pretty wide open to me, and i dont know about you, but i slow down when i go around curves that might restrict my view.
