Fleshlight's response to torrent traffic

This is Fleshlight's official stance on torrent traffic: We feel that torrents are a great source of traffic if used the RIGHT way. By right way, I mean if you have content that is yours, approved for use by a particular company, or public property and want to pair that with a Fleshlight ad, please do so. We however do NOT condone our affiliates (because Fleshlight has NEVER purchased any ad space on a torrent site) using our ads with stolen content. If you have copyrighted content that shows directly with a Fleshlight ad, let me know (personally, not unprofessionally through a forum) and I will deal with the situation (affiliate) appropriately. My contact information is as follows:

email: josh @ fleshlight.com

is there ever a RIGHT way to promote on torrents? I mean after all torrent sites MOSTLY capitalize on stolen content...come to think of it I only know of ONE site that uses torrents that doesnt have any copyright infringing links

Why do they always complain about you posting it on a forum? The forum is a great place to bring it to the attention of others for discussion and awareness, or when you don't get a reply to an email.

You know for a fact that %99 of the content on torrents are stolen. By taking this stance fleshlight is just as bad as that scum that run the torrents.

What does that have to do with anything? If you're trying to say that because we have advertised on here in a professional manner that others should be able to bash us on here before contacting us directly or knowing our position, you are wrong.

Well that was a bad answer.

Either it's Fleshight's policy to allow these sorts of affiliates or it's not.

This "well it depends on how it's reported to us" stuff is asinine.

I'm saying that if you think forums are so unprofessional, then you should look close at what made your company what it is today, and who did the hard work for you - It was mostly honest webmasters. The same webmasters you screw over by putting money in the pocket of content thieves.

Will this be added to your TOS anytime soon? I think it's important for new and existing webmasters who don't frequent GFY to know of this, and so to have your stance on torrent traffic very clearly and explicitly outlined in your terms of service would be quite important.

Also, in your TOS, it says:

Quote:
The following types of subject matter are considered unacceptable and will not be permitted on an Affiliate site:
Child pornography and/or any depiction of underage participants (including participants who are dressed and depicted as underage, even though the participants are clearly adults);
Incest;
Bestiality;
Images or content that is in any way unlawful, harmful, threatening, defamatory, obscene, or otherwise legally prohibited;
Promoting fraudulent, unlawful, misleading, or unfair business practices or involving unfair competition;
When an affiliate advertises on a torrent site, then is the torrent site automatically defined as the "affiliate site"? If so, then all torrent traffic would be unacceptable since torrent sites routinely advertise content that depicts child pornography, incest, beastiality, content that is unlawful (stolen), and they are sites that promote unfair business practices (making available stolen content).

I think you would want to clarify a few of these issues, you know, in specific and precise terms instead of giving the "if you see it, report it" stuff.

Just my .

Here we go again with the personal insults. I've never had anything against you personally BoyAlley so why you would attack me personally, I have no idea. I can tell you that I don't have the time to jump on every single thread that may appear on various forums. If someone wants to contact me by the methods I provided, it is simply an easier way to make sure that I see their complaint.

I don't think this is at all a "personal insult". I'm commenting on a policy of Fleshlight, not on the size of your penis?

If you would like me to comment on your penis, however, feel free to email me pics and I'll be glad to do so.

PS: As for me jumping in every thread you appear in etc. etc. I jump into a LOT of threads every week. I'm kinda a post whore like that. w00t w00t.

We are not responsible for all content that may appear on torrent sites. We are, however, responsible for the content that appears with our ads. If our ads appear with any child pornography, incest, beastiality, content that is unlawful (stolen), we will have those ads removed.

I got a question for you ... how could you promote "correctly" on a torrect site that is showing scenes from our $50,000 budget movie? That was just the budget .. not the fact that by it playing there i could potentionally be losing DVD and Web sales.

They have stolen the content .. without consent, hosted it without consent .. and now your going to correctly promote on their site by REWARDING them with a check for some fucking ad space?

Wow .. i used to have respect for you guys. I even sent a buyer at the largest distributor a fleshlight as a gift. I am sure he will be thrilled to learn how you guys as a company have made a stand to REWARD THIEFS!

99% of toy distributors .. are DVD distributors .. your fucking with their business too .. not just every studios whose content is up there ...

I don't get it, why would posting links on a board be considered unprofessional?

- Someone posts a link to a site that promotes fleshlight using stolen content
- 5 minutes later we see that fleshlight links on the site no longer work
- everyone sees that fleshlight is serious

seems like a better way to show affiliates that you are serious about not supporting stolen content sites...

What sort of monitoring system do you have in place, other than waiting for outraged GFY'ers to post on the forums here or contact you personally?

If this is your policy, then I would sincerely hope that you have something better in place to make sure that your product isn't consistently advertised in a manner counter to what you've intended. The TOS itself, as I'm sure you're painfully aware by now, isn't doing much.

How do you make sure your ads aren't being served next to such content? As you've admitted, you don't purchase adspace yourself on torrent sites, and therefore you haven't much control over where it appears. So what gives?

Edit: Tree-fiddy.

Because by the time I have even had a chance to see the matter, let alone attempt to do anything about it, these threads have grown to a Fleshlight bashing session before anybody even knows what we may or may not be doing behind the scenes to stop whatever the matter may be.

Correct me if I am wrong but doesnt most of the ads on torrent sites rotate.

Doesn't the content on these sites change from day to day on the same pages.

Everything is constantly changing. Instead of saying " We are not responsible for all content that may appear on torrent sites. We are, however, responsible for the content that appears with our ads. " why don't you just say:

Affiliates, you can not advertise on torrnet sites, we know that 99% of them contain stolen content, or other unlawfull things and we do not want our ads next to such content. If you do advertise on one of these sites your account will be shut down and your affiliate money will be donated to an organization that is being set up to fight content theft. We can't pay you or you would just keep making new accounts. We can't keep the money you made because then we would be profiting from torrents twice as much as we are doing now.
ok maybe i am dreaming a little with that last part. God forbid a company (any for that matter) really step up to the plate like that.

Some of you guys want pats on the back for picking up the bat, a hand full actually step up to the plate, waiting for a company to actually hit the fucker out the park.

I'm glad you feel that way about the webmasters being ripped off. Good luck on finding people to market your new line of products coming out soon.

Unless we post about it on GFY before contacting you......if we complain that we're being stolen from in a public forum before contacting the almighty Josh, then Josh is ok with profiting from content theft.

Well my best guess is that's because till now nothing was ever dealt with
or you just forgot about letting the people here know about it.....

You guys show the matters is being dealt with you watch how fast the
bashing swings around to appraisal.

Considering your position on this subject You're a "Fucking jackass" when it comes to this. Don't know you personally and not even trying to attack you personally. This is a business and your business model fucks us all.

seems like a better way to show affiliates that you are serious about not supporting stolen content sites...
We all know how this works. If the person contacts them, they say they will take care of it and they hope the person forgets about it. If the person does follow up and sees they did nothing then at worst they have pissed off 1 person.

On the other hand, it is posted here and 20 people will keep following up on it, and they are forced to do it.

I agree to notify the company, they might not read the boards and emailing them should be the fastest way to contact them. But i don't think it is unprofessional to make a post about it.

how about this, send them an email first, and then make a post telling us that you just contracted them about ....... etc...

Or if you want to give them the benefit of the doubt, email them about the problem and let them know you will be posting this to GFY if there is no resolution in 3 days, and copy the convo here when you make the post.

yeah how funny, i was owed thousands of dollars by fleshlight a long time ago and tried email/icq for months with no real response only the run around. i posted a thread on gfy about how they owed me $ and was paid within a few days.

I totally agree. We all saw how Jules Jordan and Evil Angel just won 11.6 million if i am correct.

When we have people like Fleshlight rewarding theif's .. eventually content producers can no longer make decent/any content to promote .. where is everyone's check going to come from???

This does not only fuck with studios/content producers .. it screws over everyone in the long run.

So if someone sue Fleshlight, can they get a court order to get access to the affiliate system? I don't know the law over there.

If it would give access, it could show just how many torrent and content theft sites they pay

Hello. I have a question Josh.

If a regular affiliate gets caught promoting Fleshlight on a site with blatent CP on it and we complain to you about it, so they then merely move your ads to pages without CP on them yet keep the CP and your ads on the same domain, are you guys going to allow this and not terminate their account and keep their money? Does this policy apply to regular affiliates as well.

Thanks.

There is no "right way" to finance piracy. I'm sorry, that's total bullshit and a cop-out way to try and justify you lining your pockets. I will never promote Fleshlight until they get on the right side of the tracks.

IMHO, those who promote on Torrent sites can't make it in the real world, with real traffic, or they are simply too greedy for their own good, and it will bite them in the ass at days end.

How far do you want to take this? Should the internet not be available because illegal content is all over the internet? We police direct infractions as they apply to us.
