Trey, don't get me wrong here. I'm fully with you on the point that it's fucking theft what these companies have done to both sponsors and affiliates alike through methods such as Zango. I hope you do nail them and change things for the better.

What I don't have any faith in, really, is the North American legal system(s). I come from a large company corporate background and I've witnessed first hand large companies with giant bankrolls destroy smaller companies when by all reasonable accountings the smaller company was well and truley in the right. Microsoft, which is NOT a place I have witnessed this happening because I've never worked there, is famous for just this sort of thing.

I will be making sure that safe way gets word from my attorney of what is about to happen. after i approach AFF and see how serious they take me. I am pretty sure AFF doesnt want safe way to get wind of a fairly large lawsuit aout to filed against them way before they could evver manage to slel the company them. it takes 1 day to file a lawsuit and amend it later. a sale of their conpany will take weeks or even months.
I have the advantage by far.

incase AFF decides to read this and uses their head, they will look up my attorneys back grounds and hopefully make the right choice by contacting me and epiccash or my attorney and figure out how to not fuck up their sale and get this to go away.

pimpdog on gfy is not the same as Trey protecting his company off the board.

CNN is perhaps the best idea in this thread. Once the announcement is officially made, your team could exert a LOT of pressure on Safeway.

Safeway is a grocery chain, and as such, will be subject to pressure of everyone from environmentalists to religious nuts. It is possible that the wrong press over the AFF deal would kill the transaction. Not sure that's a wise move, to take it so far, but certainly Safeway is touchable on a PR level that AFF neer had to be concerned with.

You're also correct about settlement language-they can contain anything.

However, I find it hard to believe you would refuse a deal that:

A. Gives you say, 10 million dollars

B. Acknowledges no wrongdoing on the part of the defendants.

C. Requires you to keep your mouth shut for life.

I know the idealist in me (and probably you and everyone else) would like to think otherwise. Sure, it would be great to protect your brethren in the biz, but in the end, it HAS to be about you and your family. I don't think anyone can condemn that.

I certainly don't see a settlement being offered or reached that would admit guilt or set up a precedent for others to come to the Safeway trough.

Now, going to trial, well, that's a different matter and certainly could result in many more suits, if you are successful. Unfortunately, you probably won't have a verdict either way for at least ten years.

Yeah the same lawyers who wrote Lars' public statement that he posted on GFY where they publicly admitted that 1. they were using zango and it wasn't a rouge affiliate, and 2. they were aware that "adware collisions" were happening. I know the idealist in me (and probably you and everyone else) would like to think otherwise. Sure, it would be great to protect your brethren in the biz, but in the end, it HAS to be about you and your family. I don't think anyone can condemn that. I certainly don't see a settlement being offered or reached that would admit guilt or set up a precedent for others to come to the Safeway trough. Now, going to trial, well, that's a different matter and certainly could result in many more suits, if you are successful.
