Check Fraud and what I'm doing about it.

Apparently a check was stolen from my office and yesterday it was cashed for $1000.00

The bank has already refunded my money but I've decided to push the issue further since the bank will not be going after anybody for such a small amount.

I have the persons name, finger print, & signature. I used some of that info to track her down. Got her MySpace, her Social Security Number, DOB, and her last known address which her, her mother, and her sister were evicted from on November 16, 2007.

As I mentioned, the bank gave me the money back but now I have a problem with not knowing who stole from me. What I want to do is get this girl to tell me who gave her my check so I can take care of the thief.

I'll be on top of this until I find her then we will see how things go from there.

Posting here mostly to vent. I'm sure most of you don't give a fuck......

She has no clue the bank is not going to pursue it. I do not think there is anything illegal about fibbing and telling her you are a PI. Continue the lie and explain that you will just give her information to the bank unless she cooperates and tells you who gave her the check.

UPDATE:

So the girl called me almost in tears after reading what I sent her and her boyfriend on MySpace.

Anyway.....Turns out she lives with the maid I use at my studio and that's who she got the check from.

Now I have to decide what to do about the maid.....Other than fire her.

Ok so it is again a bluff in parts and yes your gaining an extra 1000.00 but fuck thieves. I'm not attorney but the word extortion comes to mind when I think about doing that. That would make me no better than the thief who stole from me.

Well it also could be a settlement for not turning them in as you could turn them in.

Or yes you could just turn them in and get them busted by the police. You have the bank evidence and such.

Was your maid bonded? If so I would also go that route and if not, not using a bonded and insured maid is just crazy.

It's kind easy when somebody steals a blank check then writes it to another person and tells them that they can't cash it at the bank it's issued from because they owe them money.

The fucked thing is that this person is more than just a maid. She's been a friend of mine for a few years now. I have my money back but I've also lost somebody who I thought was a good friend.

Not sure if I'm going to turn her in or not. She's a single mother of a 6 year old. Not my problem but again...What do I gain if I turn her in? Nothing. And the bank won't go after her for a grand so again...why bother turning her in?

Just write the friendship off or????

Right, I didn't realise it was blank. This makes it even more ludicrous, does she think that you wouldn't notice that a check for an arbitrary amount was drawn on your account?

IMHO you should come up with something that will give her a good scare and make her think carefully about what she's done, but don't turn her into the cops. Perhaps hint at future action if you ever hear of anything like this happening again.

Another shit thing is that if she would have told me she needed the money, I probably would have helped her out. I've helped her a lot over the last 3 years or so. Now she won't have me to lean on in the future.

Since I now know and the bank has paid me, I may be legally obligated to turn her into the bank even if they choose not to prosecute her. I would hate to break some sort of law and end up getting bitten in the ass on this by withholding her info from the bank.

I had a similar situation happen a few years ago. A guy I thought was a friend came over to my house and when I was in the other room stole a blank check. He ordered new checks and had them sent to his house then set out writing them all over town. He also opened up a handful of credit accounts in my name. All in all it ended up being about 40K worth of credit and bad checks. It took me over year to get everything fixed. I pressed charges and he is in jail now but he is in for assaulting his girlfriend, not writing bad checks. They did it that way so it would be a violent crime and be his second strike, one more and he goes away for a long long time.

If it were me I would press charges. The reason would be so that she would fully understand that when you need help or are desperate you can't just steal from people then cry to them and have everything turn out okay.

Glad you got your money back and found out who did it though.

Maybe you should speak to her, find out her reasons why she done it. If you believe her cut her a break, if you don't believe her turn her in. There's no excuse for stealing from someone, especially someone you consider a friend but desperate people do things that they normally would never do.

At least give her 5 mins to explain to you, then you can make a decision from there.

That's exactly what I was getting ready to write...

That if she'd come to you asking for help for a legitimate reason, you'd of likely helped her with no problem. Now, instead, you're all twisted up over it and rightfully so. The fact that she stole from you rather than ask for your help makes me wonder if there's something going on she's not willing to fess up to.

I had a maid a few years back that stole a piece of jewelry from me. I'd known the girl for many years. It tore me up that she could do that. When I confronted her about it she of course denied it at first, then told me that she'd taken it to give to her mother as a gift. I told her if she'd asked me if she could have the earrings I would have likely given them to her, but instead she'd ruined a good relationship.

I'd say call the bank and feel them out. Tell them you have a lead or something and see if they'll tell you what they'd do if you found the person.

Beyond that... follow your heart.

States have different laws, but where I live, either you or the bank can prosecute. If the bank declines, you can still persue charges. If it were me, I'd fire the maid, turn in a police report, and get a warrant on both for the theft of the check. Otherwise, they will continue to steal from people, and get away with it... BTW, you should immediately order a credit report, to be sure they haven't opened any accounts in your name, that you don't know about...

I actually knew a case just like this, a check stolen from a business and it was even for $1,000. It was a bar I worked at yeeears ago, a manager got fired and then forged a check thinking she wouldn't get caught.

And yeah, when you report it to the bank, THEY will press charges. She frauded them, not you, because you got your $$ back. Its pretty serious, she's going to be in some trouble for sure.

I just remember hearing the outcome of my experience, the bar owner laughed it off because he didn't have to lift a finger to even prosecute her, and it wasn't like she could even be pissed at him over it.

The bank probably already notified law enforcement.
