Vice versa youtube is looking for people within the production chain who uploaded the video therby giving implicit consent. When someone uploads video to Youtube it appears automatically on Youtube; Pornhub`s employee have to approve uploaded video before it appears on Pornhub.

an adult tube site has the issue of dealing with content that in and of it self can be illegal (CP/beastiality etc).

That content is illegal to own, which means it is undeniably illegal to upload.

In the case of copyright infringement it not so clear,

What if the person is authorized to upload the videos

What if the person has a fair use right to upload the video

the uploader claimed to have some rights to the video by uploading it, how do they know who is lying.
If your arguement is they must have personally bought a right to the video then you no user upload would be valid. All Fair use rights would be prevented including explictly defined ones like parody and commentary. The safe harbor provision would have no meaning for the adult industry.

Do you really want to set a precedent that we can ignore certain rights when talking about adult companies.

considering that without the 1st ammendment this entire industry would be prostitution do you really want to make the arguement that certain laws should just not apply if your in the adult industry.

so let me get this straight you believe that every video card and sound card has high level processor built in to decryt the data at it source.

you really think your encrypted stream sends the data to the video card in an encrypted manner. You think the encrypted stream sends encrypted data to the sound card.

While the quality would be no where close to that found inside the site (not dvd quality) you could get a copy but since it would be uploaded to tube sites which have lower quality anyway.

hell with tv tuner cards in many good video cards, i am sure i could redirect the "encrypted stream" through the tv output and just mpg encode the incomming tv signal with an open source linux pvr like mythtv.

I am sure average surfer would not have the necessary skill to do such a redirection but that doesn't mean i don't. And if you pissed me off by trying to cost me my adult income stream i would be willing to sacrifice a couple of months of income to try.

It is possible your "encrypted stream" over rides device level redirection, but i doubt it since on xp/windows nt etc that requires administrator permissions. And if i were to signup and the site video did work becuase you required "administrator" rights to install i would charge back the membership.

worst case i could target all the sites that send you traffic instead i am sure they all have not decided to go to encrypted streaming for all their videos.
