Doesn't matter as the TM is sextube and not the word tube. So NO he can not sue youtube.

I can see anyone questioning the steps being taken but I can clearly understand what it is to protect a brand. THe thing is that the TM is rather vague I would say as in 2 general words. Thats the problem, but hey Shap if your lawyer says you can get it than I wouldn't care less.

Its not intimidating letters its intent of legal proceedings Shap owns the trademark and he is actively pursuing anyone who is in violation of that.

TNAFlix.com has a ton of stolen content, and probably a ton of traffic along with it. You'd have to be pretty comfortable with copyright infringement of other content owners to advertise there.

Lots of lawyers will give bad advice. Maybe his lawyer is just telling him to do it but has no real plans on suing or just doesn't care because it's not his money. And threatening to sue can make people cave in to your demands, a lot of people do it just for that reason.

Love the expired adult domains in your sig, and we have held domains for girls and companies if they ask for them most times we hand them over, or redirect to their sites on request. Hard Sex Tube is different enough a judge would let him keep it. Sex is a pretty open word. If it was a problem we would all have to stop using anything with sex.com in it... Like hardsex.com or indiansex.com. Hard is a distinct classification of a sex act. Just sucks that you have to hire a lawyer to keep a website with almost no traffic.
