If all the evidence they have is scratch mark with no sign of sexual assault, then he was framed, if they find signs of sexual assault and DNA evidence, then he probably did it.

Here is my guess as to what went down based on everything I read. He left the bathroom naked and saw the maid. Neither of them expected to see each other. The maid was an immigrant from Senegal in Africa, so she spoke french. Since she came from such a macho country, she was probably very embarrassed, and that came across as being playful. He got all turned on and started joking with her, then quickly ran to close the door. She got even more embarrassed. From what I read he was only in NYC for the one night and that was because he was visiting with his daughter for lunch (or something like that). Since he wasn't there on 'official' business he can't use the diplomatic immunity card.

It could be that he repeatedly does this but he's usually covered by diplomatic immunity. If that were so, he might have just grown accustomed to being able to do what he wants when he wants, and he forgot that he wasn't covered this time.

It could also very easily be a frame (maids are not above being bribed I'm sure), and considering he's knee-deep in the political scene, anything is possible.
