I never understood embedding because it's virtually unknown to surfers that the site isn't hosting the video. It felt the same to me as if I'd just pay someone in India to upload to a tube or do it myself.

Easier to license older full length scenes and pad with sponsor promo vids with banners to their site under the player. One can license full length scenes for tubes dirt cheap now.

Private has done embedding cases before? I ask because I do not know. Don't really follow it because it always seemed wrong to me.

So many people embedded tube sites these days to do trades with and it always seemed so wrong. I could never figure out why they thought they were different than a tube full of studios videos. If you click a lot of the embedded videos they are dead from a DMCA received by the original tube.

Another weird thing is that some people who claim to hate illegal tubes and blame them for decreased business somehow think embedding full length videos is somehow OK.

By attacking a high profile affiliate who embeds videos, a common practice in our industry, they are putting fear in the eyes of other smaller affiliates who do the same. However they are going to lose a lot in the eye of the general affiliates opinion.

A case like this has a lot of meaning to the future of our industry and the current affiliate model. If the courts side with Private on this issue, affiliates will become responsible for verifying the license of the content they are using. Google could even be held accountable for the advertising on search results that link directly to these videos.

I just can't see how this case has merit, beyond the obvious "scare-factor" it is already bringing around the industry.

Money well spent for Private as a company, but Boneprone is the unfortunate and unnecessary sacrificial lamb on what I believe is a misdirected claim.
