California passes bill letting non-citizens serve on juries

Thought this was pretty interesting. I think this could run into a lot of problems though, especially with jurors not being impartial. But the gap between rights of citizens and non-citizens in the country seems to be closing more and more. Doesn't seem like there will be too much of a benefit of being a US citizen a few years down the road. Do you think other states will follow California's example?

Assemblyman Bob Wieckowski, D-Fremont, said his bill, AB1401, would help California widen the pool of prospective jurors and help integrate immigrants into the community.

It does not change other criteria for being eligible to serve on a jury, such as being at least 18, living in the county that is making the summons, and being proficient in English.

The bill passed 45-25 largely on a party-line vote in the Democratic-controlled Assembly and will move on to the Senate. One Democrat ? Assemblyman Adam Gray, of Merced ? voted no, while some other Democrats did not vote.

Democratic lawmakers who voted for the bill said there is no correlation between being a citizen and a juror, and they noted that there is no citizenship requirement to be an attorney or a judge. Republican lawmakers who opposed Wieckowski's bill called it misguided and premature.

Assemblywoman Diane Harkey, R-Dana Point, said there is no shortage of jurors.

"Jury selection is not the problem. The problem is trial court funding," Harkey said before the vote. "I hope we can focus on that. Let's not break something; it's not broken now. Let's not whittle away at what is reserved for U.S. citizens. There's a reason for it."

Wieckowski's office said the bill is the first of its kind in the nation and suggested that courts regularly struggle to find enough prospective jurors because jury duty is often seen as an inconvenience, if not a burden. His office did not cite any statistics but pointed to a 2003 legislative report that said numerous articles have noted high rates of non-participation.

A 2007 survey by the Center for Jury Studies said 20 percent of courts across the country reported a failure to respond or failure to appear rate of 15 percent or higher. The center is run by the National Center for State Courts, a Virginia-based nonprofit dedicated to improving court systems.

It's not clear, however, if that rate translates to a shortage of jurors in California.

Noting that women were once kept off juries, Assembly Speaker John Perez, D-Los Angeles, said the judicial system should be changed to allow a person to be judged by their peers.

"This isn't about affording someone who would come in as a juror something," Perez said. "But rather understanding that the importance of the jury selection process of affording justice to the person in that courtroom."

An estimated 10 million Californians are summoned for jury duty each year and about 4 million are eligible and available to serve, according to the Judicial Council, which administers the state's court system. About 3.2 million complete the service, meaning they waited in a courthouse assembly room or were placed on call.

In 2010-2011, the most recent year available, only about 165,000 people were sworn in as jurors.

The judicial branch has not taken a position on AB 1401.

Carbon is not the problem, it makes up 0.041% of our atmosphere , 95% of that is from Volcanos and decomposing plants and stuff. So people in the US are responsible for 13% of the carbon in the atmosphere which 95% is not from Humans, like cars and trucks and stuff and they want to spend trillions to fix it while Solar Panel plants are powered by coal plants

I'm guessing the problem is they can't get enough jurors. I've never done it but I'm told by those who did the process was a huge waste of time - sit around and wait all day, and then get sent home.

Maybe we should have professional jurors? Paid?

That's awesome actually, once they show up and get asked if they are a legal resident, once they answer 'no' INS can put them in cuffs and in-front of the judge who's trial they were going to be on the jury for... An awesome way to save tax-payer money

If they are sitting around all day doing nothing and then go home, it sounds like we have plenty of jurors? the problem would be above that somewhere.

Not sure about that... when I came to the US from England, some of the guys I came over with were under 26, and they were told they had to register for the draft.

I was just on jury duty--for a whole fucking week--and didn't get called. The problem is that I'm a freelance photographer, and couldn't book any shoots that week as I didn't know if I'd get called. And I couldn't go on vacation.

It's unfair because if you work for any decent sized company, they'll pay your salary/wages while you do jury duty. To make it fair, I think that should not be allowed--nobody should be paid anything.

Jurors are paid.. but it's minimum wage.

We already have "paid" experts in court cases and far too often these guys are just "experts" saying what the the guys paying them, wants them to say. Do you really think it'a wise to go down that road with a jury?

It's unfair because some people work for themselves and others work for companies?

I used to work for the phone company and they paid 100% of our wages when we were on jury duty, and the courts loved us. Not sure where you live, but usually, around here anyway, you are on jury duty but you call in the night before to see if you have to report or not.

Minimum wage? In CA we get about $5/day as I recall. That isn't gas money.

I absolutely would most definitely not accept that if I were to stand trial. A jury of my peers is NOT immigrants who hate the fuck out of white people. Illegals sneer at us like WE are here illegally and they DESPISE us. I'll be damned if one of them is going to be sitting in the jury box at MY trial. That'd be like allowing a klansman to be a member of the jury at a black persons trial. It'd make no sense.

But anything is possible these days. We have sotomayoro or whoever that spanish looking woman who hates white people is as a member of our SUPREME COURT now so who knows WHAT they will do next.

I'd not accept it. There HAS to be SOME line drawn.

Good point. I didn't mean that I do. But I do know that I've caught the good ol' "I wish I could kill you for being white, you trash" from immigrants of questionable status a whole damned pile of times. Some Mexican people don't hate white people, some do.

No.

I give everyone the same chance. Not much of one. White, Black, Mexican, you name it. I don't trust anyone. But I've known people of all colors I've gotten along great with because they treated me properly and I treated them properly.

Racist against human beings, maybe. I don't like most of them. I don't like being one.
