Oh my God help me please. extremely noise neighbors above me and I can't work *STOMP* *STOMP*

Yesterday I moved to Silicon Valley into a cheapie apartment and everyting is fine, but it seems there is a woman above me and her 6 year old-or something son who is constantly pounding on the floor, screaming, and crying.
Stomp Stomp Stomp. Right now as I type this I think he is jumping off the sofa and on to the floor.

I mean it is constant, there isnt a 30 minute break.
I work from home, this is killing me, I cant concentrate.

Any suggestions for anything to cancel out the noise?

Im stuck here for 12 months and cant get out of it, so I need a way to deal with this noise.

A white noise machine? some headphones? Im going to get some ear plugs now and see if that helps.

Have you ever lived below somebody before? If you have, is this woman worse than prior situations? Unfortunately, it's really pretty common and the person upstairs may not be doing anything out of the normal at all. Apartment floor/ceilings are notorious for this.

Such are the perils of apartment living. Instead of freaking out on a porn webmaster board & looking for a lawyer after a few hours, why not take the common sense approach - go upstairs and talk to her about it, explain you work from home etc, if she's at all a decent person she'll try to limit her kid jumping around. You may have gotten jobbed with the accoustics (again, apartment living) but I don't understand why people don't just take the direct communication route these days...

The apartments were cheaply built. Amoung other things the flooring in the apartment above was very likely just nailed down and not glued and screwed down. Very common problem with cheap construction and nothing you can do about it. It's very unlikely they are going to tiptoe around the house for you and even if they did that it probably won't help because most of the noise is coming from the flooring itself.

Apartments in California are all build with wood structure which really allows for noise to pass thru the walls and really amplify it. This construction material is used as the areas are subject to earthquakes. Some noise proofing is needed to keep the noise out BUT most apartment buildings do not do much of this! I have lived in places that we very quite so it is really necessary to move really to a place that has done that. If you have a year long lease you might be fucked!

Been decades since I've lived in an apartment, but as I recall there should be a clause in your rental agreement that stipulates that tenants must not make excessive noise which is irritating to others (assuming you're not a crackpot who expects absolute silence living in a downstairs apartment).

If that is the case, I would recommend that you take it up with the landlord, and if possible back up your complaint with evidence such as an audio recording from your cell phone or video camera.

When we had to move into an apartment for a few months last year, the very first night, well actually it was first thing the next morning, I could hear the couple up above me fucking like crazy.

I think they did it as a 'welcome to the building' for us...

Not sure about California but in just about every place you are entitled to peaceful enjoyment. I would tell the landlord you are unable to work because of the noise and to let you out of the lease (or put you in another unit) or you will sue for moving expenses, etc.
Soundproofing is out of the question because of the expense and it is almost next to impossible to soundproof that kind of noise because it radiates through the studs and into your walls. If the landlord is resistant then start recording the noise for proof, break the lease and move, fuck that shit.

Tell the landlord exactly why because it will be the same reason the last person left.

Maybe he can move you to the top floor on the other end of the building.

If he can't move you then just break the lease, they will say that you can't, you say "I just did".

and...today I saw a bedbud crawling on my pillow. I JUST bought a new bed ffrom walmart 1 day ago so I know its not from me.
It was bugs in the infested carpet, which I told them to steam clean before I moved in and they said they did, but obviously didnt.
I fucking hate this place, I want to leave

I just moved in, sucks to move into a place and know on the first day you have to suffer for a full year.

Based on my experience unless you find some headphones or a way to cancel out the noise you are fucked. I have lived in a few apartment complexes with noisy neighbors and it never goes well. You can report her to the landlord and maybe if you do it enough they will force her to move, but more likely they will play the, "He's a kid, sorry," card.

Noisy neighbors just don't stop on their own and trying to outnoise them will just cause them to be louder still.

There is a maximum allowed noise tolerance that is stipulated by the law. You need to call court officials (this is how it works in my country) and they will measure the "amount of noise" and if it is above a certain level you can take them to court.

For example a guy in my country won a law suit against a neighbor who flushed his toilet at night.

Lol reminds me of the first apartments I lived in. They were old and had thin walls. I feel your pain, I had some similar situation not so long time ago... I'm afraid the only possible solution is to move out and to find something in peaceful area preferably with reliable agency/landlord and preferably on a last floor or with thick beams. If you just moved in it's great because you're not tied to the place, you probably put not much work in this place yet and it will be easier to find something since you're already in the area you want to be.

Also the thing with kids is that sometimes parents do not control them and even if she will be willing to cooperate the kid might not want and nobody will force it to behave. Also if you can hear so much noise now already then it means the floor/beam is really thin or/and wooden and there will be more situations when you will hear it no matter what the deal you will made with her now.

You're gonna run into this problem living in any apartment block, rent a detached house. If you can't afford to do this then look for people who are looking for a housemate, look to share with one other person who has a detached property.

These are your options, or you can be miserable and complain for the next 12 months.

I know, right? Im going to go there tomorrow and show them the dead bedbug, and tell them I really would like to leave and let me go out of my lease.
Otherwise I will call the booard of health, association of relators and property managers, leave bad reviews on yelp and facebook they I know they often engage with their customers on, etc etc.

Hopefully they will see me as a pain in the ass tenant and just let me go.

The price is low, there has to be a line of people who would move in there. everything else in the area is like $300/month more
