Rant Couple found guilty of having sex on a Florida beach, faces up to 15 years in prison

It?s been dubbed the ?sex-on-the-beach? trial.

A Florida jury on Monday convicted Jose Caballero, 40, and Elissa Alvarez, 20, on charges that they had sex on Bradenton Beach in broad daylight. They face up to 15 years behind bars and will have to register as sex offenders.

Each of them faced two charges of lewd and lascivious behavior, carrying a maximum penalty of 15 years in prison, the Bradenton Herald reported.

Defense attorney Ronald Kurpiers told the newspaper that Caballero and Alvarez were ?devastated? by the jury?s decision.

Prosecutors ? including the elected 12th Circuit State Attorney Ed Brodsky ? sought a conviction in the high-profile trial to make it clear that such behavior is not acceptable on the community?s public beaches.

?We?re dealing with basically tourists, that came from Brandon and Riverview and West Virginia, and they?re here on the beaches of Manatee County, our public beaches,? Assistant State Attorney Anthony Dafonseca said, according to the Herald. ?So you want to make sure that this isn?t something that just goes by the wayside. And that it is well known to the community, what will be tolerated and what won?t be.?

Prosecutors said Caballero could face the maximum 15 years because he has been out of prison for less than three years on a drug charge, but they will seek a more lenient sentence for Alvarez: 60 days in jail, though she still has to register as a sex offender, Fox affiliate WTVT reported.

Dafonseca told the station that prosecutors offered plea deals but that the pair rejected them.

I remember that case. Apparently there were kids watching and people told them to stop and they didn't. And they weren't hiding anything like most people fucking on the beach would try to do. 15 years is still a joke. It's actually scary how long some of these sentences can get for somewhat harmless crimes.

It wouldn't surprise me if the same Prosecutor had just made a plea deal with a murder the day before offering a reduced sentence of 7-10yrs.

The fact that it is "sooo" hard to figure out who is the murder is a real shame.

"Dude shoots someone in their house, drops the gun with fingerprints on it and flees". Cops arrive on the scene and accidentally kick the gun or stupidly pick it up and put in somewhere safe. Cops tape off the scene and nobody enters the area until it is scrubbed by ci. In working legal systems weak case goes in favor of the accused, but not exactly like that. But as you don't have working legal system in any way, that is poor case anyhow.

And yes, it is not always easy to find who is the murderer. I mean actually finding him, not just putting some guy into the jail. And after finding him; sentencing him in the court.

How a so called "weak case" is defined matters most. The point I am making here is that today our biggest problem is that strong cases are flipped to appear as "weak cases" because of things like assuming evidence was tampered with because some CI trustee wasn't the only one who touched said evidence. That is just one example of the kind of retarded that has infiltrated American Law.

It's a rare case that the prosecutor will put someone in front of a Jury who doesn't deserve to be sentence for the crime in question. Since crime in America is so bad there are many instances where the prosecutors only option is to put a known murder on trial for drug related crimes. That is one reason why you will not see the DOJ releasing all the so called, "non-violent" drug convicts. Many were locked up for one crime, but have a history of others that are unsolved.

Lastly the sentencing in America has completely failed. I don't give two hoots and a nut if you think passive punishments work better; you're wrong! Here in America people used to be severely punished. The death penalty was nearly instant. If you were convicted of a crime and sentences to be executed, you were read your last rights and given a chance to say one last word before they tied a noose around you neck right there in the courtroom and let the floor drop below you feet so you would hang and die right then and there. Just think about that for a second. Murders were executed within minutes of being sentenced. Go get a history book of crime statistics and look at the murder rates throughout American pre-1900; less that 50 per year. Today murders spend their entire life on death row in some states, but most are released after 5-7 years and allowed to live in society again.

I will never agree with any punishment for murder besides execution and swiftly at that. I would vote to go back to the pre-1900 styles of handling those kinda BS humans too.

I have heard that in some other countries courts use common sense. Relating to that evidence tampering and such.

What comes to that prosecutor thing; he isn't the one who decides someone being guilty or not. So, how we know that does the accused deserve something or not, as it is the court that decides that deserving part? And anyways, in 90 % of cases he does plea deal, no court, no peer-review, nothing. And many of these plea deal guys/girls are innocent even in very hard crimes (those they haven't actually done). It has been studied.

What comes to the hard penalties you seek after, I have just one word: Merica.. well.. and Isis.. jihadist Somalia.. actually there are lot of words.

By the way, your pre-something murder rates are not probably that well compared to these days, you know: methods/ resources to even define crime having been happened, population number, etc. have all changed.

1) Public sex is not a porn. It's a disorderly conduct. Max punishment for that article is up to 15 days (not years!) of administrative arrest. But not in case of public sex of course. For example, if a person was drunk and rowdy (beat someone or crushed some property), then he definitely needs a few days in prison to think about his behavior. In all other cases you will be fined with $500-$1000 (according to the administrative code). Taking into account the total corruption of Russian police, you'll get away for $100.

2) The legal status of pornography in Russia is uncertain - and this is about distribution which can be legal and illegal (actually nobody knows what legal/illegal distribution is). Shooting of porn is absolutely legal (e.g. home video or filming of an orgy in a swinger club are not forbidden). Also there is no law against of viewing and storing of any kind porn (even if it's zoo, cp or any other shit).

3) In fact, only shooting and distribution of cp is a crime here. A serious crime, I'd say. Everything else is ok.
