I have been dealing with incorrect and unbelievable DMCA;s requests from these same idiots.. My issues is we got at least a couple hundred this week

Examples of these idiots Infringing emails

1) The original material is located on the following URL(s):
https://test.com/test">\u0...65st

We are the duly authorized representatives of the exclusive rights holder for Mistress Ava;

We are the duly authorized representatives of the exclusive rights holder for Michal12222209738838383838;

The original material is located on the following URL(s):
https://test.com/test">\u0...65st

We must have responded to their erroneous DMCA's to fix this problem 100 times, we never get an email back

Their website- https://dmcapiracyprevention.com/
1) The email on contact page is the same email these damn erroneous DMCA's come from and are not answered

2) The Phone number I have tried over 25 times and goes instantly to busy signal

I must have over 100 emails from them now sitting in my inbox, we have been wasting time trying to communicate for days with Absolutely no response

We all understand their job but when things become so reckless and time wasting, we must stop this, I am sure others too must be dealing with the companies tactics

I ask the community for any suggestions, my attorney is looking into this also, I was hoping this situation could be fixed as I had this issues a few weeks ago with Another Piracy company and they admitted a software problem and apologized

This Fucked up company is no where to be found and I am wondering if anyone can suggest something

Many Thanks

Branditscan dot com is the company behind this international criminal operation DMCA privacy prevention.

The DMCA law has a protection clause against false reports, in addition they sign in google that the notifications are correct, which incriminates them every time they send a false report. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly in-fringed.

"The DMCA provides a remedy for these bad-faith takedowns, specifically:

Any person who knowingly materially misrepresents under this section—

(1) that material or activity is infringing, or
(2) that material or activity was removed or disabled by mistake or misidentification, shall be liable for any damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by a service provider, who is injured by such misrepresentation, as the result of the service provider relying upon such misrepresentation in removing or disabling access to the material or activity claimed to be infringing, or in replacing the removed material or ceasing to disable access to it.

17 U.S.C.A. § 512"

Here is a case for recent abuse of false DMCA on software: https://www.eff.org/document/johnson...orio-complaint

The guy behind DMCA Privacy Prevention is (or at least was) one of the top guys at ManyVids.

They have been DMCA trolling for a while now. Unfortunately, the only thing that will stop them is legal threats & action.

Those idiots are taking down half of playboys content, claiming it comes from onlyfans.com

I would like to know if someone had been successful getting their site whitelisted in their system. I tried to contact them, but they dont answer.

I guess the next step is getting legal council. Is there a Canadian lawyer on the board? Any advice?

Guys

thanks for great help

If someone with a Canadian lawyer can help us all, we can all join in a class action suit if this is the correct terminology for this matter

I am here to jump in, Im just not as smart as you other guys

You don't need Canadian. The law is American...

It's the funny part of all this, their entire business is based on an American law that they haven't even read. Because there are two clauses, fair usage policy and clause 17 U.S.C.A. § 512 against false reports.

Every time they send a report they are signing legal documents with Google that the reports are correct, Google simply accepts all reports in good faith. They can't be more stupid because they incriminate themselves in every report they send.

Use this if you are only using the chaturbate API, it has worked for me with a lot of these false claims

My site xxxxxx.com is a site that only use the API from Chaturbate to promote the live model feeds from the main Chaturbate site. There are no other pictures or banners with content of this model (xxxxxxxx) or other models illegal taken on my site and have never been there before.

Since all models on Chaturbate have to agree with the TOS of Chaturbate, all the models have no right to claim a DMCA notice if the site only shows the live feed from the Chaturbate API, that also counts for complainer xxxxxx.

So I hereby ask you to declare this complaint unfounded and not to remove my site or this url from Google.

Kind regards,
xxxxxx

Not sure how much success you would have, but I would try reaching out to Playboy to see if they have an outside law firm working on the problem. If you get a name, talk to them.

Ive threatened them in the past for clients and they have quickly backed down. They know what they are doing is an issue.

Guess that"s just life this days, part of the daily grind.

I'm glad the DMCA exists as I have to use it from time to time, some idiot likes to post my c4s vids on a few tube sites. luckily all the tubes pretty much immediately remove my stuff with no hassle. I just have a template I use, and switch the c4s clip link and the infringing URL and boom, done

what infuriates me is not just that companies like this create hassles for legit affs and stokes conflict between affs and performers, but that it's also outright theft from performers/creators who PAY for these so-called services. I know one of their 'ambassadors' depicted on their home page, I bet she doesn't even realize how scummy this company is

$45 per month or $450 per year for this crap? ugh

Guys- Be careful

Hello Again,

I have been dealing with these idiots for weeks, a nightmare no one deserves, my guys remove DMCA's like lightning, yet these idiots and another company that I had to deal with also , still do shit thats is beyond comprehension

Hi Ross,

Our sincerest apologies for not contacting you earlier. We always aim to provide our customers and partners with the highest quality of service. However, it appears that your domain was impacted by a technical error where your counter-takedown emails were not being received. There is never a situation where we want any legitimate website to experience this and we deeply apologize for the stress this must have caused.

Unfortunately, we cannot go back in the past to fix this error on our part, however you can rest assured that this incident will not be repeated. We have retracted all of those claims from Google, and have put a failsafe in place where your website is on a global whitelist where it will be exempt from future removal requests from our system. Please note that you might still receive some DMCA notices in the upcoming days since they were dispatched before we whitelisted your website. If you have affiliate websites that should also receive this treatment, please let us know. The error with our mailing system was identified and we have added a new email account where our team can be reached directly “[email protected]” - in addition to that here’s a number where you can also contact us: +1–913–513-2140.

Again, we cannot stress our sincere regret for this incident.

Yours truly,

Michael

Now these idiots are sending to my guys instead of thru my DMCA link, I have told them I will continue to show case their stupidity until they get their act together

It is unfortunate that honest guys need to waste hours upon hours battling

They have updated their website to reflect a new email and phone number, the other phone number, I cant believe a company would be so stupid to make it non- reachable.

anyone else having to deal with these idiots, you can see above the new phone number

good luck

Thanks

Ross

A summary of things we have learned on this thread about this company:

The lumen link that The Hun posted, allows you to request the specific URLs that were reported. It's clear they either didn't verify/vet/confirm, or they don't care to. They just sprayed and prayed, using a common term (matching the model's performer name), and issued notices regardless of what resulted from that search.

That's why you can see

...which include Target.com, PlayStation, and Audible. You have to be pretty ignorant, reckless, or apathetic to the potential liability into which you are placing your clients, to issue notices like that.

In their response posted by a GFY member, they essential said, "sorry, and also you're going to get more because we can't control our automated system," (in so many words).
http://m.gfy.com/fucking-around-and-...revention.html

It's tantamount to blaming the dog, when you fart. "Sorry, the automated system, which we created, own, and operate? Yeah, it's that system's fault."

Their approach seems to be, "you're guilty until you prove your innocence via counter notice," which shows a complete disregard of the industry, the work they do, the time and money they put into their own content and posting of that content. If you're BIS, your approach seems to be "we don't care - we issue the notices, invalid as they may be, and you deal with the fallout. As long as we are winning industry awards, the general industry people will believe we are experts. "

The fact these guys don't seem to be humiliated, or change their ways, despite multiple times being called out on industry threads, and privately, tells you all you need to know about them.

Beautiful analysis. I heard they were using machine learning to detect the urls lol but i am sure they use generic name matching and it’s quite a dangerous approach.

Thanks again, for the lessons
well it prob helped that peeps were also discussing this over on the boring place where under the BrandItScan moniker they had a sales thread and apparently even won an award for 'marketing'

yours and the other dude's thread here def helped bolster that discussion as Wasteland linked to them both in that thread

still, I consider their biz practice theft from performers/creators and affs through their irresponsible biz model until they can prove they have altered it to the extent that this 'DMCA everything that involves a performers name' shit has stopped

right now it seems like they're just reacting to complaints, not providing any info on how they will change their spiffy system so it doesn't happen in the first place

in my case, I have goog alerts set up for the diff variations on my cam names and real name. I share a real name with a prominent astrophysicist who lives in another country. my most used cam name is also that of a tik tok chica just doing her thing, along with a couple of porn creators who look nothing like me and are not infringing on me in any way in choosing a cool name. I get the g alert emails, check the provided link and delete. simple

when it is my stuff posted I DMCA, but most of the time the alerts have nothing to do with me

can you imagine if I paid these two companies (DMCAPP and BrandIt) money to pull this ish and charged me for creating unwarranted hassle in the lives of others?

until they solve the problem "I'm sorry, we'll whitelist you" is not enough

thanks for raising this here BMW, and for (unlike them) being proactive in trying to address the issue
