Ok, now that we've reached 300, this thread no longer has any purpose other than to win DUC an XBOX...

The real thread is here (not started by me.. although if someone wants to send me an Xbox I wouldn't send it back)

Really... the IMPA guys (well, homegrown anyway) just came in and acknowledged the worthiness of this thread:

So come on over, pick up your magnafying glass and get to work

This is common practice in the sale of companies, as is the employment contract for ongoing management after the sale. A potentially huge liability from Acacia throws a monkey wrench into this sale. So FM settles with Acacia to remove this potential liability. While I am sure this can be fairly characterized as a move to protect CE's ongoing business, this looks like it also was protecting the sale of CE from running afoul. To me this shouldn't be read as a testament to the strength of Acacia's case since there were issues here that are unique to CE and not the adult industry as a whole.

David, stop making sense ;)

CECash settled with Acacia for good reasons. If the patent is not invalidated, the volume that CE has done in the past would be open to 'patent infringement'. This could mean up to 5% for the past 6 years, this would be a tremendous financial burden, so CECash signed a licensing agreement.

This doesn't mean we don't want to invalidate the patent, it was a business decision.

We will still stand financially behind those who are fighting the patent, which is lot more than we can say for most of the industry that has not been served with a lawsuit.

Like a post by Far-L says above, those who think they're hiding from Acacia should think again. If they are not successful in invalidating these patents, everyone will have to pay for 'patent infringement' going back 6 years and run the chance they may not license you going forward, this is why CECash signed a license, it was business decision.

Acacia holds these patents in 26 countries. So if you think you're not going to be impacted by this, think again. Either way, you should either sign a license or support those litigating the patent or do both. To stand on the sidelines, watching, doing nothing could land you in a world of financial hurt!!

This is all that will be said by CECash on this matter.
Well said Ron - It's sad you had to explain yourself - exactly what I assumed when I saw the tread - Anyone around when Sex.com was slapping sites with restrain orders and court papers knows you have to deal with the leaches and Acacia seem to be the biggest leach since Cohen was extorting fees from adult sites with "sex" in their domains based on a lame patient on the word sex!

Ron, exactly how much have you put forward of your own $ toward the IMPA?

Can the IMPA comment on this, has Ron been a contributor like he has lead everyone to believe?

To my knowledge, the bank account for IMPA will be set up in a day or so.

Takes a while to set up non-profit organizations. This has to be done by-the-book and is not a small undertaking.

I believe Ron's initial post said "will" be contributing- I'm sure he will live up to his word.

Look for more official posts from the IMPA tomorrow.

Ron, I have not given a dime.

Most of this is news to me, only heard of it the other day. I have already been in contact with the CFO of IMPA today to see what I could do to help and have some questions answered.

I wanted to take a second to comment on people contributing to the IMPA and its causes. To make things clear the IMPA is going to be able to accept donations by tomorrow at its website. www.impai.org.

To clear up the confusion regarding Ron?s donation, We have not accepted it as of yet due to the need to incorporate the non profit organization correctly.

As for Mike AI and Brad, to their credit they are ready to help out. Beyond this point everything else is moot.

CE has not been the only company that has settled or is in negotiations. Over the last few months I have encountered people that wanted to sit back and watch it all take place with out spending a dime.

We are at a watershed moment in our industry. We either rise up and deal with this threat together or we allow companies like Acacia to come in a steal a % of our business.

Finally I want to make this clear to everyone that the companies involved with this litigation are taking a stand not only for themselves but also for this industry. Without the industry working together to defeat these guys they will roll over us all.

If you have any questions feel free to contact me directly at 949-716-8080 or [email protected].

MikeAI and BradShaw rather than throwing stones, why don't we all turn our attentions to a real industry problems and try to deal with them. We can bash each other anytime

Really dealing with these problems means money. In the past, the GIA ran into brick wall because of money issues. It was folded into the Free Speech Coalition, where it resides today. This happened because the members stopped their financial support.

The Adult Industry industry has been targeted. Lawyers are using the law in a perverse fashion to grab a share of the industry's grosses, or make them pay big money settlements for Vicarious Copyright Infringement or some other far reaching law.

Does anyone know what Vicarious Copyright Infringement mean?

It means, as it pertains to our industry, that if a site that sends traffic to an affiliate program, and that site has unlicensed photos, hence guilty of Copyright Infringement, then the affiliate program is guilty of 'Vicarious Copyright Infringement'. Even if you have no knowledge or control over that site, you're guilty.

If you read the law, the exact few paragraphs of Vicarious Copyright Infringement, you will be chilled by its verbage. It gets worse when you see what statutory damages are money wise, absolutely incredible.

The bottomline is the industry has problems. To fight these problems, support is needed from all of those in the industry. That suppport equates to money, nothing else, money!
