Some senators do understand that that laws like this one will only affect US-based websites, and that offshore ones will slip right on by... I think they really do understand that websites can move themselves offshore, but it's just a feel-good short-term solution that they are looking at.

This is just a political ploy by a couple Dems to appeal to conservatives. It will pass, there is no doubt about that.

That would mean the end of free porn in the US if this goes through and the ACLU or the FSC are unable to have it struck down.

yup, although ICANN was under EU pressure to rescind its power, the US gov put ICANN in charge for the forseeable future. That means ICANN is under US gov control, and if it goes through you can expect shit to hit the fan, and the adult industry left to fight its own battles over cyber squatting, SEO, and other fallout issues.

Bascially if you're a US based site owner you'd better hope this doesn't go through or you'll be forced to deal with massive headaches with transition moving your business aborad, or even bigger headaches with .xxx

anyone assuming this would only hit US based sites and businesses better also assume that with ICANN under US control - scratch the idea of it being for a forseeable future only, noone can seriously expect Verisign to engage in big negotiations in 2012, so the "presumptive renewal" right given to them effectively means a US controlled entity, namely Verisign, has everlasting control over .com and we will probably see a similar deal for the Verisign controlled .net at some point - we could also expect TOS following suit and forbidding adult material under non-adult TLDs.

then add a bit of filtering for catch phrases, a bit of grassing up from rivaling webmasters, and we'll basically see the germans' crap with 'webmasters' and lawyers making a living from pissing on each other on a worldwide scale.

And for those of us who own websites with the same URL and different TLD? What do they do, draw straws to see if the .com, .net, .org, .ws etc get the new TLD?

Why can't parents be responsible for their children? There are filters now, what makes them think that filtering out .xxx will work if the current filters don't work?

No, if any sort of mandatory .xxx ever goes live, you'll be left to fight it out with every big-money domain speculator on the globe for the .xxx versions of your current domains. Trademark law may give you some preference in certain cases, but I wouldn't count on that too much. \

It will be bloody and messy and the shit will be falling out for *decades*.

My logic is fine. No such thing as a democrat in a republican state. fact is Montana has participated in 29 presidnetial elections and voted republican 18 times. Including 12 of the last 14. At least I looked up FACTS and not spout off at the mouth.
