You use it, you owe it. Same deal here. Violation of a TOS agreement maybe terms for suspension/termination/forfetiture, but you can't change a percentage payout inleu thereof. A sale is a sale and if you violate TOS, you can't complain about being terminated, but that doesn't change the agreement the owner has with the affiliate to pay set percentage for validated sales that come through. TOS violations reflect that status of your account. You can't partially pay an affiliate and claim TOS violation. Even partial payment is acknowledgent of a valid sale and under valid sale agreements, you are entitlied to the set percentage. |
