I've seen other images used in adds and such. Possible to take a look at the members area so I can make sure none of our stuff is there? (People grap a lot of our old stuff off the newgroups which was posted by an old member, we have never posted to newsgroups ourselves.)

I'm done fucking around with these guys. They have all been issued DCMA's for the offending content and failed to listen. Now I'm going to go after them for the thieft. I'm giving them the weekend to stop using my content to promote their crap or I bring in the lawyers and yes, I do have a firm on retainer. I have documented this infringment for awhile now, and have sent DMAC letters to hosts, domain owners etc. Including original watermarked images that have been edited by the offender to remove my watermark and use for their own means. Take this as the last warning.

I have 3 others on my shit list also so far... but I will be dealing with them 1 at a time...

Gets Better... I signed up to unrealbanks affilaite program and guess what, they are using MY content in the hosted gallery system! So not only does that show direct thieft of my content, but also that means that they are not 2257 compliant either, since they have absolutly no documentation on any of these pictures....

Gonzo knows me personally, and knows that I would not start some fake drama.. In fact I have been MORE that patient in dealing with this. Well, lets see here. I'm the guy IN the pictures... Samantha Luvcox is my EX WIFE. I Own Extremehole.com and Took the pictures personally. Except for the ones that I'm in in which I had a friend take for us. Great that your willing to stick up for a friend, but there is NO question here. Even in the email back from your friend he admits he and I quote "I bought a few of the sites with some content on them and have already had to remove a picture set." So, It's shows me that he doesn't even know where the content on his sites originate from. I would also like to ask him about the Payton content I see him also using, I know Payton. She has been retired from this industry for a couple years know and as far as I know the only people with any rights to any of her stuff is ME, Dennio, and I believe Abraxa shot with her. (Any of course Lisa Luv, who is also retired now and again the same story) These guys that think they can go out and strip content from around the internet to build a pay site without any regard for those of us that actually created and own that content do nothing more that piss me off and it's time to start calling them out. Like I said I have a small list growing of other sites doing the same and I'm going to publically out every fucking one of them. I'm actually being the nice guy here, I'm giving him the weekend to permently remove the content I own from his servers/sites My next step is his host and his billing company ccbill, who I also use. I have absolutely no problem posting ANY information showing my proof of ownership, including the ORIGINAL pictures, and signed releases for those pictures. In fact in the original email to him I sent along a copy of the original etc. There is only a couple sites on the net that have access to any of the content that I or my ex wife have done. Fistingsex.com has some sets they paid to use. Dennio.com has some of our VERY early stuff that I don't even use on extremehole, since I shot it for his exclusivity, and people that we shot with in group setting. (Porno Dan, Sammy4u, Brittney Andrews, Rhiannon to name a few) But the list is VERY short and well documented. Unrealbank IS NOT one of those on that list.

Jensen, we have never met, but from having visited your site and getting a sense of how you seem to conduct yourself, I believe you are sincere and operate ethically.

When I saw this post, the claims did not balance with impression of your biz.

Gerco, as you raised this alarm (on a public forum), can you please explain the diff in communications? It sounds like Jensen understood the matter to be resolved. Did you send further communications which were left outstanding and unanswered?

While there is no excuse for content being published without permission, when purchasing and/or inheriting a web realm, there may be skeletons the new owner is unaware of.

Is this just a case of the communication trail broke and the complainer assumed the 'alleged offender' was no longer cooperating, while the 'alleged offender' assume the matter was resolved - aka unneccesary drama which could have been resolved with an escalated attempt at communication (ie written registered letter, phone call).

What am I missing here?

Simple. This is how it's going to be from now on. you use my pictures or my video without my permission, you not only get the DMCA letter to you, your host and a extra to your billing company for good measure, but if it's not resolved on the FIRST attempt, I'm bringing it to the boards. I'm sick of all the places I see my stuff being used illegaly and I'm making an effort to put a stop to it in the most direct and public way possiable. There is NO excuse. How can anyone claim they have "rights" to any image without anything writen from the photographer, the models etc.

You people that are just pulling anything off the net that looks good to you to push your business are going to learn in a public way that this is incorect. I have tried to go the private email way, it does not work. It costs me time and money to issue DMCA letters. It takes time and money to try and track those that are stealing the content. This SHOULD be made public, not just in my case but in EVERYONES. There should be a site dedicated to outing people and companies that are doing this and if someone is busted using stolden content then there should be a place for those others to see that. It just so happens that there is not such site... but there is GFY. Notice how fast things can get taken care of right here. Companys don't want to have there names here in a bad light and will do anything to try and make themselves look better. Fine. At least it's getting the job done. Like I said before. What I don't understand is how did this content end up on sites it should not have been on? Was there ANY prior arrangement for the design and galleries in question which was later revoked?

If you're finding your content in unauthorised places today, should it never have been there or is this a deal which has changed hands/gone sour and now it's no longer cool with you?

As far as unauthorised content use, personally, I don't believe in Cease and Desists - that's for wimps and it lets cheaters off the hook (if they stop when they're busted). The damage is already done. Suggesting someone stop doing more damage (as it is being added to their bill) is a good idea, but many content thieves assume they will get away with copyright infringement if they stop when they get a C&D.

If they knew that they were violating copyright (ie. they did not have a license in hand at the time), they have incurred damages. A C&D does not absolve them of those damages, but it may help them not dig their hole deeper if they're smart.

Your absolutely correct. Why should I keep spending $$$ fighting these guys, and still the drag thier feet or do nothing about it or do it AGAIN for me to spend more $$$ and time, meanwhile they make $$$ buy using my contnet without my permission. Not a wonder that they do it. So no, now it's time for public disclosure of the thieft.

Pretty clear cut if you ask me, There is no way that they "the content thiefs" (and this includs unrealbucks) had any licence to said content, yet they used it in thier design, offered it to thier AFFILIATES via the affilaite program and hosted the content for the affilaites to use, for what 7 months now from the first that I saw of it. Yes they did respond to the email I sent, but did anyuthing actualy get resolved from that email... no.

This is all fine and good if it is a clear case. And that's what puzzles me here - is this a clear and simple case? The content was *never* allowed (even in any affiliate context)?

How much simpler could I make this out for you...

1. I own the content.
2. This content has NEVER been sold to anyone.
3. In this case, Unrealbucks took the content and offered to affiliates via THIER OWN PROGRAM in the hosted galleries section of that program, flooding the internet with my ripped off content.
4. Unrealbucks has been using the content in thier ACTUAL site tour, right in the MAIN HEADER.
5 Unrealbucks owner was informed of this infringment 7 MONTH ago, yet the content remained in his affilaite program and on his site design.


I have sold a few sets in the past, to a site called fistingsex.com The sets I sold them are not the ones in question. The sets I sold Fistingsex, gave them 6 months exclusive rights for that content and then that content reamined on fistingsex, while after the 6 months I retained ownership of the contnet and was and am able to use it as I please. For the privlage to use those 3 sets they paid me 1500 bucks per set.

If Unrealbucks wants to truly cover damages then match that. They have at least used my content for 7 months, if not longer, All in all I count a found total of 4 sets used from thier affiliate program and 1 set used in the creation of the objectfreaks header for a grand total of 5 different sets used. Going by what I have sold my sets for in the past this would = 7 thousand dollars. Was not meant to be rude. but it is fustrating. If I was one of the larger sponsors here the sheep would be screaming bloody murder about the thief. Since I'm a smaller player they think it doesn't effect them. Well, as affilaites it DOES affect them, because if your found using any stolden content then your going to get knocked down for it. Here is a case where the affilaites are trusting the sponsor whoes even hosting the content and they could get in trouble also.

What do you think the responce would have been if Steve Lightspeed had found some of his content used in the exact same manner? Would this be a thread with 5 people comenting or 500?

At least the Galleries look to have been removed from the affilaite system at this point. the Header is still up and running and not changed yet...

Well, I just got off the phone with Ccbill Policy Review over this. and just finished sending them all the required documentation. I also made it a point to send the same documentation to Objectfreaks host Webair and directly to Unrealbanks admin (again) It will interesting to watch the outcome. Ccbill was VERY helpful over the phone and said they are going to get with "Jensen" on Monday and if it's not taken care of freeze his accounts.

Well, the issue just got bigger. After digging deeper I found that he has used the content in question on his FHG. The new DMCA which ccbill, webair and he just got is 47 pages long and affects Unrealbank.com. objectfreaks.com, ratherextreme.com, fistingking.com devilspen.com, shockingextreme.com and fistordie.com.

Ccbill downloaded it directly while I was talking to them and webair has escalated it to their management telling me I should here back from them in the next 4-5 hours.

Since he took down the very first little DMCA I know he's aware of it, I hit him up on ICQ no response, nor has he tried to contact me via email about the issue. So I was left with no choice.

Had he been a man, and lived up to what he said back in the beginning we would not be here today.
