New internet piracy law comes into effect in France

The first effects of France's new law against internet piracy will begin to be felt as the new year begins.

The law was passed after a long struggle in parliament, and in the teeth of bitter opposition from groups opposed to internet restrictions.

Illegal downloaders will be sent a warning e-mail, then a letter if they continue, and finally must appear before a judge if they offend again.

The judge can impose a fine, or suspend their access to the internet.

The Creation and Internet Bill set up a new state agency - the Higher Authority for the Distribution of Works and the Protection of Copyright on the Internet (Hadopi).

The law was backed by President Nicolas Sarkozy and the entertainment industry.

yes and force them to change the law, the law coming will force those that have content on their servers to have a document proving they are allowed to have it kinda like 2257, 3 times they dont have it and the domain and servers are gone,

1) How do you think the ISPs are going to pay for the added workload they will have to do to police their customers?

2) How do you think that a case gets proved? My wireless router isn't password protected. So anyone near me COULD be downloading illegally using my connection. So in this system you think is great, I would get my internet access removed. How is that great? (also spoofing IPs is a piece of piss).

not their job, but if your connection is suspended, you have to pay the bill anyway (for nothing).

Now you are responsible of your connection. So your connection can be canceled if someone is using your connection to download copyrighted files.

Anyway there is a lot of unused laws.
If i receive this kind of letter (if this is an error or if they think that i downloaded some illegal content (how ?) ), first i'll reply to the letter then since i'm working with internet at some moment, i'll just move to another country.
Right now it stinks to much, i have already some problem because i wrote something in this self-proclaimed country of freedom. Just the kind of law that you can use against people to ban them from an internet that becomes more and more useful.

d) How do you actually PROVE someone downloaded a file? Deep packet analysis. So you lose all privacy as the ISPs have to monitor all your traffic to work out if you MIGHT be downloading something illegal.

You really think all that is a GOOD SOLUTION?

I think Grandpa John should keep his eyes on what his snotty grandkids are downloading, Bob should secure his wifi, Try spoof my IP, Leave the proving to the professionals.
I think its a start to downloading copyrighted material. Who knows whats a good solution and what isnt until you try it. Do you not try new things?

Yep going after the end user is not a solution, they need to target ISPs. I think they should impose kinda "know your client" policy for ISPs worldwide, like they did with the banks. Under such a policy ISPs will still have their safe harbor, but only when they know the real name and address of their client and can hand it over to either law enoforcement or to the copyright holder for future court case, if this client was caught uploading infringing materials (this goes for both free and paid service providers). If the infringing client could not be found, ISP is responsible (3 strikes or whatever the exact procedure will be, doesn't matter).

Wrong. Grandpa John and Bob would get warning letters, followed by a second
set of warning letters. Only if they ignore both warning letters and continue to allow
someone to use their connection for theft, then they go to court. If the court finds
that they knowingly allowed it, then the connection could be cut off, but most likely
they would get a fine.

Wrong again. You can't spoof my IP and download a file unless I let you.
You can hide your IP by using a proxy service, like those "anonymizer" services,
in which case the IP shows up as the IP of the proxy service who makes a profit
from helping you commit unlawful acts and they are held accountable for what's
downloaded through their IP.

Here's a quick IP 101 -
It's kind of like mail order. Your computer sends a request to the server, saying
"please send this file to me, using my IP address 101.42.88.11". The server then
sends the file back to that IP. If you lie about your IP, you'll never get the file.
Just like if you sent a letter to some mail order company and lied about your address -
you'd never receive the package they send back.

Wrong again. We have written software which will prove that you downloaded and
posted content without any involvemnet from the ISP whatsoever.
