Adult Film Star Content Refuses To Give Refund + Harassing Emails

-On March 20th 2013, our company bought the license to a set of 1000 SD scenes from Adult Film Star Content.

- After our payment there where several days of delays from them in sending us the license. The owner of the company (keith) also screamed and hung up the phone on me during a call I had placed to ask him why the license still had not been sent.

- Even with these issues, the bulk price we worked out with them was great and the content we paid for was eventually delivered so on April 30th we purchased a second order of 1000 SD scenes.

- We NEVER downloaded any of the 1000 videos in this 2nd order and we also never received the 2257 documents for any of those scenes.

- On May 13th I contacted Keith (the owner of the company) and requested a refund for this 2nd order. Keith refused, insulted me and threatened to sue us.

- I did not want to have to do a chargeback because we also sell products online and I'm fully aware that a chargeback has a very negative effect on an online seller. So I sent Keith multiple emails asking for my refund but he stopped responding to any of my emails so I contacted our credit card company and asked for a chargeback.

- After we did a chargeback I thought this was the end of our problems with Adult Film Star Content. However, 2 days ago I logged into that email for the first time in a while and saw that Keith (the owner of AFSC) had sent me 2 very harassing emails.

Here's an email he sent me on August 15th:

We received a chargeback today against your credit card.

We are filing criminal charges against you for theft and fraud, and will press charges to have you arrested since the amount of your theft is over $500.

We will be posting all your personal and private information on the web for everyone to see, so no one else gets scammed by you.

We will also be filing a civil lawsuit against you for the full value of the contract.

Finally, we have your home address and will be contacting your neighbors and any associates and notifying them you are a thief and a conman.

Here's an email he sent me on August 21st:

We have filed criminal charges against you, and asked for your arrest since the amount is over $1000

We have notified your bank and credit card company you are a fraud and a thief

We are now contacting your neighbors.

When you SIGN a contract and commit to it, then you don't have the right to reverse payments - that makes you a thief.

-We do not understand why Keith is harassing and insulting me when NOTHING from that purchase was delivered to us. Again, I want to make it 100% clear to everyone reading this post that NONE of the content in the purchase that we did a chargeback for was ever delivered. We never received or downloaded any of the videos or 2257 documents

- Adult Film Star Content violated their own refund policy by refusing to give us a refund for a purchase that was never delivered.

Here's what it says in the refund policy available on their site: If you ordered content and it was never delivered at any time, then under that circumstance we will permit a refund.

- Our biggest mistake in this situation was not researching Adult Film Star Content before we started doing business with them. After doing some quick research on them yesterday I realized they have a lot of complaints on this forum.

- I will be contacting AFSC today to attempt to resolve this situation. I will update this thread after that.

Don't bother. I rage at customers who charge back like that occasionally but there is literally nothing I can do except get my self in trouble for making idiotic threats.

Depending on the jurisdiction you could possibly complain to someone about the harassment but you are not going to be arrested.

If people could get arrested for charging back then I would have a nice little collection of jailbird mugshots to masturbate to and so would most paysite owners.

You purchased something from them, failed to take delivery, and then asked for a refund which they refused. Unless they can prove you downloaded the content AND used it, they got nothing.

Filing a civil suit would cost them more than the value of the content. I doubt it would even be worth it for them to do a small claims case. Calling your neighbors and making those allegations would leave them open to a civil suit with potential damages far in excess of anything they are claiming.

Clear cut case of internet bluster and blunderbussing here.

Let us know when they start threatening your pets and let this be your lesson to always perform solid Due Diligence with each and every prospect you intend to do biz with.

People who need 1000 SD scenes on a recurring basis don't suddenly stop needing content.

I obviously cannot help him get his money back. However, it's also obvious he's not going to be making a purchase form AFSC again. If he needs content now, or after his issue is resolved, I can help him there without the drama.

I have just sent an email directly to Keith (the owner of AFSC) asking that he stop all the insulting, threatening and harassing emails and he just replied to me with this email:

Not doing any of that.

You are a conman and a fraud. You SIGNED a contract and then defaulted.

We have filed a criminal complaint against you, and filed a civil lawsuit for damages of 3 times the contract amount. We have notified you CC company of your fraud as well as all the boards. You are a liar and a conman and you will be put in jail for theft by deception and fraud.

I hope you have good lawyers, because we are suing you for $150,000

Lets get some facts straight here. This guy is an outright FRAUD and a LIAR.

He asked for 1000 scenes a month for 12 months

He agreed to pay $2.25 per scene

HOWEVER.... he said..... "to help me get started could you only charge me $1000 for the first 1000 scenes in the first month, and then in month 2 I will make up the difference in money owed from 1st installment" ....

GUESS WHAT......

He pays his second monthly installment, and then announces

"""We are not getting the results we expected from uploading these videos so I'm ending our agreement

We uploaded videos on youjizz, redtube, tnaflix and pornerbros.""" .... and he promptly does a chargeback for 2nd installment payment for month 2 plus the money still due from month 1 installment.

So, he signs a contract for tube content at a very low price based on him doing a 12 month contract. He asks for a discount on 1st month and promises to make up the difference in money due for first months installment in months 2,3,4..... and basically says in month 2 "ya I signed a binding contract but ya, I'm not very good at this so I'm done"

The guy is a liar and a fraud, I wish I could do that with my Amex "Hello Amex, thanks for the card and the credit but after 1 month I've decided I dont want this card, take the bill and shove it up your ass"

We have a signed contract, we have his downbload logs and he lied when disputing the credit card charge.... he said "product never delivered".

It's hard enough these days selling content, last thing needed is a lying thief like this who just thinks he can sign a binding contract, USE THAT CONTRACT as leverage to get a discount on first months bill and promising to make it up in month 2, etc.... and then just bail.

So yes, we have filed a lawsuit against the individual and his company, have alerted the CC company to his fraud, and they suggested we file a criminal complaint since clearly he has committed fraud.

So beware of this guy.

Considering how many times people have complained about them failing to deliver, and the lack of judgments I see in their favor... I really think you have nothing to worry about. At this point, if I were in your shoes, I would ask corporate counsel to send a letter and have all future correspondence handled through counsel, but that is of course assuming you have an attorney. No matter because I am willing to wager they definitely do not because no attorney worth his salt would let his clients respond like they have, knowing full well that it would cause more problems for them if they did want to go after you.

Lesson I have learned from my years in biz...

Usually the ones screaming they will sue are the ones that won't, can't, couldn't sue regardless. Just tell him to have his counsel conduct any further correspondences on the matter.

He defaulted because he didn't have the money, suing him isn't going to change that assuming you did actually sue, and based on your discussing it on a public board I do not believe you did.

It's really a matter of principle here. The guy called us countless times, spoke to Tristan countless times on the phone, spoke to me (Anthony) and was hounding us for the price break in month one, GUARANTEEING he would pay the difference in month 2. A lot of time was spent on this one person, and it was all a scam.

So yes we did file a suit. because he clearly downloaded all the content, admits to uploading it, and admits to charging back his 2nd installment that included the amount remaining from 1st installment that he admits to downloading and then uploading.

It's obvious his intent was to dangle a 12 month contract (SIGNED) in return for getting a break on 1st installment. And then simply saying "I dont wanna do this anymore".

We have had our issues.... back in 2009 to 2011.... but since we implemented the auto download system things have been pretty smooth and customers happy. We have had 1800 orders in 2013 alone, so clearly we're doing something right.... do we have bumps in the road, sure we do but I address all issues and fix them right away, nothing lingers.

But when people like this come along and basically lie through their teeth, issue a chargeback and outright don't pay for what they agreed to pay for, download and use the content and then walk away from a signed contract like its' meaningless, then we have to take a stand against this kind of shit.

I have contacted our lawyer and after this post i will not comment again until I speak with him.

- I maintain and emphasize our company's stance that we have NEVER stolen anything from Adult Film Star Content.

- The terms of the contract we signed with Adult Film Star Content are not what they have stated it is in this thread and we NEVER violated any terms in the contract we signed.

- The owner of Adult Film Star Content (Keith) has personally sent me multiple harassing, insulting and threatening emails that I have made sure to archive.

- There are several posts on this same forum filled with complaints of wrongdoing on the part of Adult Film Star Content towards several other clients. Some Complaints we found where made as Recently as July 2013.

The downloads went very well, and I would definitely recommend them for anyone looking for content.

I have bought tons of content from AFSC and have never had an issue. Now true enough my few hundred picture sets are probably not comparable to the thousands of video's the average porn company buys. However they were spread out in literally hundreds of transactions and my product has always been delivered promptly.

The only thing I can say negative about AFSC is you have to email them separately to get the licenses delivered where every other company out there just includes it in the folder with the ftp download. However once figuring out that is how they do business I just send the email and promptly receive my licenses. So never had a problem with them.

Just kind of an fyi for webmasters who might not realize this. Almost in every state in the U.S. it is against the law for a debt collector or a business attempting to collect a debt for themselves to threaten criminal prosecution. Theft of service is illegal in most states but actually mentioning filing criminal charges is also illegal.

I am speaking from experience of learning the hard way about that one. So while we all do it.... if intentions are to actually file any kind of lawsuit in that case it is best not to do that because you are just about guaranteeing yourself to losing that lawsuit strictly based on doing that, even if the other person was 150% wrong and at fault.
