i've heard they have 60 new licensees from a mailing of 10,000 letters. i suspect that they might have 300 licensees by December 1.

acacia investors are beginning to UNDERSTAND that 97% of defendants will be FIGHTING these bogus patent claims.

defendants like Stanford University and Harvard Law School.


and something interesting about Judge Ware in California.


for those of you that think acacia has an easy slam-dunk with this judge think again.


"(Ware) also nixed Acacia's threatened motions for preliminary injunction," the message continued. "While Acacia has been threatening these motions for months as part of its effort to scare companies into paying up, it has not filed and has admitted that it does not have enough information to make such a motion. Reasoning that he would need to fully understand the case and the applicable defenses before he could even consider such extraordinary relief, (Ware) indicated that he would not even permit such a motion until after the conclusion of claim construction."

Ware also reportedly asked Acacia attorneys if "all the parties it planned to sue were before the court," the message said. "The attorneys responded that they were not and that they had placed additional companies on notice. When Acacia told (Ware) that they had sent out thousands of cease and desist letters, (Ware) seemed very surprised."


acacia's clumsy tactic of sending thousands of letters out to webmasters, many of whom do not even have video will backfire and be seen as what it is---an extortion attempt.


IMO acacia will NOT receive preliminary injunctions against ANY website business before April 2004 regardless of the merit of the acacia case.


which means IF you are sued RESPOND TO THE LAWSUIT.

As I said over on the tunafishbitch board, it is no one's business if someone donated or not. I personally have disclosed that I have donated to the IMPA the second I noticed that their paypal link was up, but I can respect the right of others who wish to keep their donating practices private.


I am, however, happy to read the posts here by Latinasojourn. Here's hoping this is the beginning of a long down-turn for Acacia, hopefully it is soon to be the last we'll see of their extortion tactics. But I hazard a guess that they aren't going to go away without a long fight, there is still much to do.

My comment wasn't about donating to IMPA or FTP, it was about whether people had actually signed a deal with Acacia or not. If you want to keep your donations private thats fine, but I think the public should know who has signed deals with Acacia and who hasn't.

If you don't get an answer, do you go off and assume the worst? Having said all that, I will point out right here and now that for myself, I must admit that my level of respect will be greatly reduced towards those sponsors and companies that do cave in and sign. I don't like it, but if we're being honest here..... I haveto say that that is true in my case, especially those sponsors and companies that have disclosed private information regarding their affiliates. When it all comes out, and in the end it will.... there will be some companies no doubt that find their loyal webmasters leaving their sorry excuse for a company in droves.

Maybe you forgot to read the title of his thread... calling me a 'jackass'. And of course his other posts on GFY calling me an 'assclown', etc. and basically trying at every opportunity to discredit me. Public scrutiny is fine, i always respond with the truth.

He deleted all my posts so I couldn't defend myself...real nice.. .,. in every thread that he has popped into make his comments, about my credibility, my intentions.. i have held my ground. His first posting against me was four months ago, calling me the "board hero of the month"...guess what....it's four months later, and i still pound away at the boards, helping webmasters and providing information....and i STILL have received no compe\nsation from anyone... it's my own money and time that I have spent.

Looks great that he runs the IMPA banner on the site.. but that's because of people like you and Chowadog support IMPA.

If you don't believe my approach is the way, that's fine.. but being libel and name calling completely reduces his own integrity.......... if you also don't think IMPA is the way either.... makes you wonder who side one is on.

Notice how i don't run the pledge drive? Lots of webmasters supported my idea, but not enough.... so i took it down.

When the next patent case comes through, people like 12clicks and hustler will just settle...leaving the rest of the webmasters to fend for themselves.

I hope the webmasters rally behind IMPA...so far they haven't, because apathy doesn't protect you.... it doesn't care

You seem like you are a straight shooter, and given a 1-on-1 conversation with me, you will see that I am all that i have said and more (honest, straight shooter, and with integrity). 12clicks postings on his board, this board, and what came out with his exchanges with Paul should cast doubt on him...not me.. i have atleast, always been open and honest.

note...IMPA was around long before i started the idea of Fight the Patent Foundation

and the reason that IMPA supports my efforts, is because i have made a difference in finding prior art.... and i have 2 other patent attorneys from mainstream have said the same.

So yes, they are on my side, as I am on theirs.

So you must be thinking that webmasters who donate to IMPA are pissing away their money.
